EXHIBIT "H" <br /> TO <br /> ISPOSITION AND DEVELOPMENT AGREE_!VIENT <br /> SCOPE OF DEVELOPMENT 1 SCHEMATIC DRAWINGS <br /> I. DEVELOPER'S IMPROVEMENTS <br /> A. General <br /> The Develaper agrees that the Site shall be developed and improved in <br /> accordance with the provisions of this Agreement and the plans, drawings and related documents <br /> approved by the City pursuant hereto. The Developer, its supervising architect, engineer and <br /> contractor, sha�l work with City staff to coordinate the overalI design, architecture and color af <br /> the improvements on the Site. <br /> B. The Project <br /> The exrtire Site is comprised af real property, a portion of which is owned by the <br /> Developer, and the remaining portion of which is owned by the City and will be acquired by t�ie <br /> Developer for development of the Project, in accordance with this Agreement. <br /> It is the intent of the Parties that the Site shall be developed as a mixed use <br /> cornmercial / retail project, incluciing: approximately 295,350 square feet of Class A office <br /> space, 5,075 square feet of retail space, 5,075 square feet of circulation space, and above ground, <br /> at grade and underground parking with approxirnateZy 904 parking spaces. The Project shall be <br /> develope� in accordance with the approved Schemaric Drawings, attached hereto as Exhibit 1 <br /> and incorparated herein by reference. <br /> The Developer shaIl use commercially rea�onable efforts to ensure that there sha11 <br /> be no employee-only food preparation service facilities maintained by the retaiUcammercial <br /> tenants. All eating establishtnents located and operating on the Site must be open to the public. <br /> For purposes of this Agreement, eating establishments sha11 not include coffee bars, snack bars, <br /> wet bars and other similar limited food service facilities intended to serve retaillcornmercial <br /> tenants. <br /> C. Developer Fees <br /> The Developer shall be responsible for paying all applicable fees. The follawing is <br /> a list of�ees charged by the City upon development as of the date of this Agreement.
