7.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> August 26, 2013 <br /> SUBJECT <br /> Middlefield Road Underground Utility District No. 2011-1 - Public Hearing <br /> RECOMMENDATION <br /> Hold a Public Hearing, waive first reading and introduce an Ordinance amending <br /> Middlefield Road Underground Utility District No. 2011-1 Boundary and extending the <br /> overhead facilities removal date, and considering the project as categorically exempt <br /> from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines <br /> Section 15302(d). <br /> BACKGROUND <br /> Pursuant to Municipal Code Chapter 11, Article 2, Sec. 11.44., any revision to the <br /> boundary of an underground utilities district requires a public hearing and an <br /> amendment to the ordinance. <br /> On July 22, 2013, Council adopted a Resolution of Intent and set a Public Hearing <br /> concerning the exclusion and addition of territory by modifying the boundaries of the <br /> Middlefield Road Underground Utility District No. 2011-1. <br /> ANALYSIS <br /> The purpose of the public hearing is to inform the property owners within the district of <br /> the changes to the boundary and that the removal date for all overhead facilities within <br /> the district has been extended one year from December 31, 2016 to December 31, <br /> 2017 to provide more construction time for the project. <br /> As such, the affected property owners have been given notice of the public hearing <br /> through a direct mailing and a notice in the newspaper at least ten days before the <br /> hearing. <br /> The underground district encompasses Middlefield Road from Main Street to MacArthur <br /> Avenue and along certain side streets as shown in the attached boundary map and <br /> described in the legal description. Since the adoption of the district, minor changes to <br /> the boundaries of the underground district have been identified as necessary for varying <br /> reasons: <br /> 1) PG&E requested matching the City and County underground district lines which fall <br /> on the street centerline on Douglas Ave. This is due to the CA Public Utilities <br /> Commission requirement that Rule 20A projects include both sides of the street. <br />
