6.1.1. - Page 1 RE PO RT To the Honorable Mayor and City Council From the Cit Mana er August 26, 2013 SUBJECT Artist Design for the Jardin de Ninos Bird Bath Fountain RECOMMENDATION By motion, approve the artist design for the Jardin de Ninos Bird Bath Fountain BACKGROUND On April 12, 2004, Council accepted the final distribution of the proceeds of the estate of Gene Robert Cress, which named the Redwood City Park System as sole beneficiary. Subject to the terms of his bequest, the Council also established the GR Cress Birdbath Fund with just over one million dollars in proceeds from the estate. In 2006, the Civic Cultural Commission (CCC) decided to explore the possibility of using the fund to add public art in Redwood City and at the same time meet the estate's direction to provide bird watering stations where appropriate through review. The Parks, Recreation and Community Services Department and the Community Development Department have worked together with the community to produce a renovation plan for Jardin de Ninos Park with the design services of Royston Hanamoto Alley and Abey. As part of the project, an art team from Interplay Design Inc. was selected by a panel comprised of representatives from the Parks, Recreation and Community Services Commission and the Civic Cultural Commission to design, build, and install a community-based bird bath and plaza within the park. On February 11, 2013, City Council approved the agreement with Interplay Design, Inc. to provide artistic services for the design and installation of the bird bath fountain and plaza at Jardin de Ninos Park in the amount of $155,600. Several community meetings were held with neighbors and park users to receive input on design features of the park as well as the bird bath fountain. Additionally, Tom Arie Donch from Interplay Design, Inc. executed a "Waiver of Artists Rights", so that if the City would ever need to alter or remove the proposed bird bath fountain, it may do so as owners of the piece of art. On July 22, 2013, City Council approved the Redwood City Public Arts Master Plan which defined procedures for the review and approval of public art. This includes the initial review of the Civic Cultural Commission, the Public Art Sub-Committee (made up of three Civic Cultural Commissioners), the Public Art Task Force (includes the Public Art Sub-Committee and two City Council Members), and then final approval from the entire City Council.
