4. The Notice of Intent specifying the information set forth above in <br /> Paragraph 3, above, was also published and sent to all appropriate <br /> persons and entities to provide notice of the date (September 11, 2013) of <br /> the public hearing on the adoption of the Mitigated Negative Declaration. <br /> 5. The Notice of Intent and the Mitigated Negative Declaration were <br /> circulated for public review, sent to every responsible agency, trustee <br /> agency, and public agency with jurisdiction over the resources affected by <br /> the Project. (Declarations, F-DOCK). <br /> 6. This Board has reviewed and considered the Mitigated Negative <br /> Declaration, and other factual and professional opinions necessary for the <br /> evaluation thereof, including but not limited to, any and all comments from <br /> members of the general public and public agencies and responses <br /> prepared by the Port's consultants during the public review process. <br /> 7. The revisions to the Project plans or proposals made, or agreed to be <br /> made before the proposed Mitigated Negative Declaration was released to <br /> the public for review would avoid the effects and mitigate the effects to a <br /> point where clearly no significant effect on the environment will occur and, <br /> on the basis of the whole record before this Board (including the Initial <br /> Study and any comments received), there is no substantial evidence that <br /> (1) the Project will have a significant effect on the environment and (2) all <br /> the potential significant effects have not been mitigated or avoided by the <br /> changes or alterations which have been required in, or incorporated into, <br /> the Project. <br /> _3 _ RESO P-2211 <br /> Reso 119 F-Dock <br /> 09/O6/13 �,��ea <br /> S <br />
