7.2.A. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />September 23, 2013 <br />SUBJECT <br />City Manager Authorization to enter into License Agreements for the interim use of City <br />Property <br />RECOMMENDATION <br />1. By motion, amend Section III.E.2 (Interim Uses) of the City of Redwood City Real <br />Property Acquisition and Disposal Policy to authorize the City Manager to enter into <br />licenses for interim uses of City Property by ordinance or resolution (Attachment 1). <br />2. Adopt a Resolution authorizing the City Manager or his or her designee to enter <br />into License Agreements for the interim use of City property except for communication <br />antennas and other similar devices (Attachment 2). <br />BACKGROUND <br />The City is routinely asked by private parties, ranging from businesses to non -profits for <br />the temporary use of city properties, such as surface parking lots. The City <br />accommodates these requests by issuing a license agreement, which does not confer <br />property rights that accompany leases or other real estate transactions. <br />ANALYSIS <br />Per the City of Redwood City Real Property Acquisition and Disposal Policy, the City <br />Council is the only authority for entering into license agreements and, consequently, the <br />only authority for amending or extending such agreements. The City of Redwood City <br />Real Property Acquisition and Disposal Policy provides that the City Council may wish <br />to establish additional procedures so that the interim uses of City property may be <br />authorized by the City Manager or Community Development Director. The policy <br />currently provides that the City Council is to adopt an ordinance in order to delegate <br />such license authority to the City Manager. Such process is not necessary and staff <br />seeks to revise the policy to reflect that the City Council may delegate its authority to <br />enter into interim use licenses by adopting an ordinance or resolution. <br />Secondly, staff desires that the City Manager has the authority to enter into licenses for <br />the interim uses of City property. To expedite and simplify the process of executing <br />license agreements, delegation of this authority to the City Manager will not only reduce <br />the amount of staff spent preparing reports and analyses, but will enable the City to <br />respond to the changing needs of a licensee. Often the scope of a license is narrowly <br />defined by the requestor, only to discover once they are using the property that <br />unanticipated conditions arise that affect their productive and intended use of the <br />
