Section - Claim(s) and Check(s) <br />A. Approve claims and checks dated May 6, 2013 and the usual and <br />necessary payments through May 20, 2013 <br />MINUTE ORDER 13-083 <br />7. PUBLIC HEARING(S) <br />A. Appeal of the Planned Development Permit and Vesting Tentative Map <br />approved by the Planning Commission for the Pete's Harbor Project, <br />located at 1 Uccelli Boulevard (Continued from the Joint City <br />Council/Successor Agency Board meeting of January 28, 2013) <br />Bill Ekern, Community Development Director, said staff recommended that the Pete's <br />Harbor Project be brought back to the Planning Commission for review, because of <br />events that occurred between now and the meeting on January. He mentioned that <br />Council had asked the City to work with the applicant, State Lands Commission, and <br />others to address concerns raised by the appellant. <br />Mr. Ekern mentioned some revisions to the project: a parking structure without trellis, <br />the outer marina to be open to the general public, and hand load boat launch ramp. He <br />stated that the State Lands Commission had raised a number of issues that staff hadn't <br />yet addressed. Therefore, he recommended that this project be moved back to the <br />Planning Commission, so that it could determine what issues were critical and had <br />changed, and what are the environmental impacts of the changes if any. Mr. Ekern <br />further stated that today he received a letter from the State Lands Commission <br />regarding the leases on the outer harbor area and a letter from an attorney for Save <br />Pete's Harbor that also raised additional issues. He offered to answer any of the <br />Councils' questions. <br />Appellant Allison Madden spoke on various matters. She pointed out that there are two <br />groups of tenants that are working towards the same goal of making the outer harbor a <br />public marina. She said that this issue was complex with so many layers, and it <br />involved the public trust. Ms. Madden also noted, in her opinion, the necessity for <br />mitigation of the California Environmental Quality Act (CEQA) and landlord -tenant <br />manor. She opined that the State Lands Commission seemed to be intent on having <br />the outer harbor be a commercial harbor and marina. <br />CITY COUNCIL May 6, 2013 <br />MEETING MINUTES PAGE 4 <br />
