8.A. - Page 13 <br />RESOLUTION NO. <br />ATTACHMENT <br />RESOLUTION DENYING THE APPEALS FILED BY THE LAUREL WAY <br />JOINT VENTURE AND SAVE LAUREL WAY, AND UPHOLDING THE <br />MARCH 26, 2013 PLANNING COMMISSION ACTIONS IN <br />CONNECTION WITH THE CERTIFICATION OF THE ENVIRONMENTAL <br />IMPACT REPORT AND APPROVALS OF THE PLANNED <br />DEVELOPMENT PERMIT AND LOT COMBINATION FOR THE LAUREL <br />WAY JOINT VENTURE PROJECT <br />WHEREAS, Applicant, Laurel Way Joint Venture ("LWJV") proposes a 4.75 acre <br />residential development; construction of a private roadway connecting to existing private <br />streets; extension of city utilities to the residential lots; construction, maintenance, and <br />installation of retaining walls and parking areas along the new private street (extension <br />of Laurel Way); and an conservation/drainage easement serving the hillside <br />development, as well as the construction of 16 new residences (the Project); and <br />WHEREAS, the Project involves two phases: <br />Phase I — The construction of the Phase I improvements, including the new <br />paved private roadway, pedestrian paths, utilities (including water, sanitary sewer, gas, <br />electrical, telephone, and cable tv) and sewer connections to the City's, County's, or <br />private sewer systems (as appropriate), retaining walls, landscaping, drainage <br />infrastructure, and planting of all proposed replacement trees within the private street <br />along the shared side property lines between lots, and in the proposed bioswale and <br />drainage areas; <br />Phase II - The construction of the individual residences. Phase II cannot <br />commence until Phase I has been completed to the satisfaction of the Community <br />Development Director; and <br />WHEREAS, the City's consultant, Panorama Environmental Inc., prepared an <br />Environmental Impact Report (including a Draft Environmental Impact Report, a Final <br />Environmental Impact Report, and a Revised Final Environmental Impact Report; <br />collectively, "Revised Final EIR") pursuant to the requirements of the California <br />Environmental Quality Act (Public Resources Code Section 21000 et seq.; hereafter, <br />"CEQA") and the Guidelines for Implementation of the California Environmental Quality <br />Act (Title 14 California Code of Regulations Section 15000 et seq.; hereafter "CEQA <br />Guidelines") on behalf of the City's Community Development Department; and <br />ATTY/RESO.2911/LAUREL WAY JV -COUNCIL RESO DENYING APPEALS FOR LWJV <br />REV: 09-19-13 PT <br />Page 1 of 4 <br />
