8.A. - Page 14 <br />WHEREAS, from January 20, 2009 through February 20, 2009 the City held a <br />public review period on the Notice of Preparation (NOP) for the Project EIR. The City <br />mailed, published and posted on its website a NOP to notify responsible agencies of the <br />State Office of Planning and Research, all interested parties and surrounding property <br />owners that an EIR would be prepared for the Project in accordance with Section 15082 <br />of the California Environmental Quality Act (CEQA); and <br />WHEREAS, on February 19, 2010, City staff issued a Notice of Availability to <br />announce the availability of the Draft Environmental Impact Report for the Project <br />("Draft EIR") for public and responsible agency review and input; and <br />WHEREAS, the Draft EIR was circulated for public review and comment for 45 <br />days from February 19, 2010 to April 7, 2010, and was filed with the State Office of <br />Planning & Research under State Clearinghouse No. 2009012058; and <br />WHEREAS, on April 6, 2010, the Planning Commission held a duly noticed <br />public hearing and received public testimony on the Draft EIR. The City received a <br />number of letters and emails from the public during the Draft EIR public review period; <br />and <br />WHEREAS, on August 24, 2010, the Planning Commission held a duly noticed <br />public hearing and voted to certify the EIR for the Laurel Way Project. On August 31, <br />2010, an appeal of the Planning Commission's certification of the EIR was filed by a <br />resident on behalf of a neighborhood group. On August 22, 2011, the City Council <br />considered the EIR appeal and by consensus the City Council directed revisions to the <br />Final EIR and referred the matter back to the Planning Commission to reconsider the <br />adequacy of the Revised Final EIR. <br />WHEREAS, a notice of the Planning Commission's public hearing on the Laurel <br />Way Planned Development Project, including the Revised Final EIR, was mailed on <br />February 13, 2013 and duly published in the Redwood City Daily News on February 16, <br />2013, and the Planning Commission held a public hearing on the Laurel Way Planned <br />Development Project on March 26, 2013. <br />WHEREAS, on March 26, 2013, the Planning Commission held a public hearing, <br />adopted Resolution No. 13-04 certifying the Revised Final EIR prepared by the City in <br />accordance with the requirements of CEQA, adopting CEQA Findings of Fact, and <br />adopting a Mitigation Monitoring and Reporting Program in compliance with all CEQA <br />ATTY/RESO.2911/LAUREL WAY JV -COUNCIL RESO DENYING APPEALS FOR LWJV <br />REV: 09-19-13 PT <br />Page 2 of 4 <br />
