8.A. - Page 29 <br />Facts in Support of Finding: Mitigation Measure Biology -7 would require consultation with <br />the U.S. Army Corps of Engineers (ALOE) to determine which, if any, wetlands <br />on site are jurisdictional and to verify the boundaries of the wetland to allow for <br />mitigation to reduce impacts to wetlands to a less -than -significant level. <br />Mitigation Measure Biology -8 would require that the applicant obtain and comply <br />with permits pertaining to water bodies, as necessary, from ALOE, CDFG, and <br />the Regional Water Quality Control Board; this compliance would require <br />compensation for impacts to wetlands and would reduce impacts to a less -than - <br />significant level. Mitigation Measure Biology -9 would require installation of a <br />temporary cofferdam to divert water, with a pipeline that diverts the water around <br />the project site and back into the downstream drainage to divert flow around the <br />project area during grading for the road and installation of a culvert. Mitigation <br />Measure Biology -10 would require a BMP plan that includes measures to reduce <br />siltation. These mitigation measures would reduce impacts to wetlands during <br />construction to a less -than -significant Ievel. <br />Mitigation Measure Biology -11 would reduce the amount of trash that could <br />obstruct natural drainage -ways to reduce potential impacts to drainage and natural <br />habitat to be less than significant. <br />Impact 3.3-2 and proposed mitigation are described on pages 3.3-16 through 3.3- <br />17 of the Draft EIR and page 4-15 of the Revised Final EIR, which are hereby <br />incorporated by reference. <br />Impact 3.3-3 <br />Impact: Construction of the project would result in loss of potentially jurisdictional <br />wetland areas. <br />Mitigation: Mitigation Measure Biology -7: The wetland delineation completed in 2009 shall <br />be submitted to the U.S. Army Corps of Engineers for verification. During the <br />verification process, the USACOE will determine which wetlands on site are <br />regulated by them. <br />Mitigation Measure Biology -8: The applicant shall obtain all necessary permits <br />pertaining to affected Waters of the United States regulated by the U.S. Army <br />Corps of Engineers, California Department of Fish and Game, and San Francisco <br />Bay Regional Water Quality Control Board. Discharge of fill into Waters of the <br />United States will require a Clean Water Act Section 404 permit from the U.S. <br />Army Corps of Engineers and Clean Water Act Section 401 certification from the <br />San Francisco Bay Regional Water Quality Control Board. The applicant shall <br />comply with all conditions in the approved permits at all times. The permitting <br />process will likely require compensation for impacts to wetlands. Compensation <br />could include purchase of mitigation credits for the affected habitat types at an <br />established mitigation bank, preservation and enhancement of in-kind habitat <br />types, or creation and preservation of in-kind habitat types. <br />13 <br />
