8.A. - Page 28 <br />verification process, the USACOE will determine which wetlands on site are <br />regulated by them. <br />Mitigation Measure Biology -8: The applicant shall obtain all necessary permits <br />pertaining to affected Waters of the United States regulated by the U.S. Army <br />Corps of Engineers, California Department of Fish and Game, and San Francisco <br />Bay Regional Water Quality Control Board. Discharge of fill into Waters of the <br />United States will require a Clean Water Act Section 404 permit from the U.S. <br />Army Corps of Engineers and Clean Water Act Section 401 certification from the <br />San Francisco Bay Regional Water Quality Control Board. The applicant shall <br />comply with all conditions in the approved permits at all times. The permitting <br />process will likely require compensation for impacts to wetlands. Compensation <br />could include purchase of mitigation credits for the affected habitat types at an <br />established mitigation bank, preservation and enhancement of in-kind habitat <br />types, or creation and preservation of in-kind habitat types. <br />Mitigation Measure Biology -9: A temporary cofferdam shall be installed <br />upstream of the work area if the drainage is flowing during road grading, culvert <br />installation, or any construction activity involving the drainage. Water shall be <br />diverted through a temporary pipe around the work area and routed back into the <br />drainage downstream of the work area. If necessary, a pump may be utilized to <br />help displace the water. The cofferdam, pipe, and pump would be removed after <br />work is completed and the drainage would be returned to its original condition. <br />Mitigation Measure Biology -10: A Best Management Practices (BMPs) Plan <br />shall be developed and put in place prior to the initiation of project activities. The <br />BMP Plan shall be submitted for the review and approval by City staff prior to the <br />issuance of any permits for the construction of Phase I of the project. The BMPs <br />shall include silt fencing and/or straw bale barriers to be placed as necessary <br />along the edge of construction activities leading to the drainage area to prevent <br />particle laden runoff and wet soil sloughing from occurring outside of the <br />construction area. Disturbed soils shall be re -vegetated as soon as possible with <br />grass or other appropriate native vegetation. Re -vegetation shall be performed in a <br />timely manner to avoid soil erosion from rain or wind. The applicant shall <br />implement the approved BMP Plan. <br />Mitigation Measure Biology -11: The CC&Rs shall outline and require the <br />implementation of a periodic cleanup plan for removal of any debris buildup or <br />trash that may obstruct natural drainage flows, destroy or harm any natural <br />habitat, or visually mar the proposed project area. <br />Finding: Implementation of Mitigation Measures Biology -7, Biology -8, Biology -9, and <br />Biology -10 would reduce construction impacts to wetlands and drainage to a less - <br />than -significant level. <br />Implementation of Mitigation Measure Biology -11 would reduce post - <br />construction impacts to wetlands and drainage to a less -than -significant level. <br />12 <br />
