8.A. - Page 27 <br />perpetuity, including provisions for the planting of new trees and vegetation to <br />replace any future loss of existing or replacement trees and vegetation. The <br />vegetation maintenance plan shall be submitted for the review and approval of the <br />City Landscape Architect. The applicant shall implement the approved vegetation <br />management plan. <br />Finding: Mitigation Measures Biology -1 and Biology -2 would reduce construction impacts <br />to bird and bat species to a less -than -significant level. Mitigation Measure <br />Biology -3 would reduce impacts to mature tree habitat to a less -than -significant <br />level. Mitigation Measures Biology -4, Biology -5, and Biology -6 would reduce <br />post -construction impacts to wildlife habitat and special -status wildlife to a less- <br />than—significant level. <br />Facts in Support of Finding: Mitigation Measure Biology -1 would require preconstruction <br />nesting bird surveys for construction during bird nesting season and, if nests are <br />found, avoidance or monitoring of active nests. Mitigation Measure Biology -2 <br />would require avoidance of tree removal during the breeding season and during <br />the night time. It would also require conducting preconstruction surveys for bat <br />habitat and, if suitable roosting sites are found, implementation of actions to allow <br />bats to leave the area to reduce the potential for impacts. These actions would <br />reduce impacts to bats and nesting birds to a less -than -significant level. <br />Mitigation Measure Biology -3 would require submittal of landscaping plans, <br />including standards for minimum tree replacement size, to reduce impacts to <br />mature tree habitat to a less -than -significant level. <br />Mitigation Measure Biology -4 would require coordination with various regulatory <br />agencies to reduce impacts to biological resources from activities such as <br />pesticide and biocide use to a less -than -significant level. Mitigation Measure <br />Biology -5 would require that landscaping activity not damage sensitive species <br />habitat, that drought tolerant plants be used, and that no invasive species shall be <br />introduced. Mitigation Measure Biology -6 would require a maintenance plan for <br />existing and proposed replacement trees and vegetation. These measures would <br />reduce impacts to sensitive wildlife and wildlife habitat to a less -than -significant <br />level. <br />Impact 3.3-1 and proposed mitigation are described on pages 3.3-14 through 3.3- <br />16 of the Draft EIR and pages 4-14 through 4-15 of the Revised Final EIR, which <br />are hereby incorporated by reference. <br />Impact 3.3-2 <br />Impact: Construction of the project would result in loss of wetland area and could result in <br />the removal of seeps. Additional impacts to wetlands may occur due to increased <br />sedimentation. Post construction, there could be impacts to the drainage area and <br />riparian habitat from the buildup of trash and debris. <br />Mitigation: Mitigation Measure Biology -7: The wetland delineation completed in 2009 shall <br />be submitted to the U.S. Army Corps of Engineers for verification.
