8.A. - Page 233 <br />form approved by the City Attorney, for maintenance of the portion of <br />Laurel Way within the Project area, which Maintenance Agreement shall <br />be recorded against all properties within the Project area. Maintenance <br />responsibilities will include, but are not limited to the maintenance of <br />common areas, road pavement, and drainage structures/storm drainage <br />pipes. <br />11. Prior to issuance of any grading or construction permit for the Phase I <br />improvements, the HOA shall execute a Stormwater Treatment Measures <br />Maintenance Agreement, in a form approved by the City Attorney, for the <br />storm water treatment facilities maintenance of the portion of Laurel Way <br />within the Project limits, which Stormwater Treatment Maintenance <br />Agreement shall be recorded against all properties within the Project area. <br />12. For each individual Planned Development Permit of any residential lot <br />within the Project area, the applicant shall obtain private sewer easement <br />rights (as necessary) with neighbors for a private sewer lateral (if <br />necessary). <br />13 -All Phase I improvements as described in the Revised Final EIR, dated <br />December 2012, must be completed to the satisfaction of the City <br />Engineer prior to the issuance of any individual Planned Development <br />Permits for any of the residential lots. <br />14 -Applicant shall implement and comply with all mitigation measures <br />described in the Final EIR and Mitigation, Monitoring Program (MMRP) for <br />the Laurel Way EIR, adopted by the Planning Commission by Resolution <br />No. 13-04 and on file with Planning Services (State Clearinghouse <br />#2009012058). <br />16. All modifications; to said approved plans must be submitted to Planning for <br />review and approval prior to the issuance of any grading, construction or <br />building permit. Substantial modification of said approved plans, as <br />determined by the Community Development Director or his/her designee, <br />may be subject to a new Planned Development Permit per Section 46.10 <br />of the Zoning Ordinance. <br />16. Prior to any construction activity at the Project site, Applicant shall hold a <br />preoonstrucdon conference with City staff and other interested parties. <br />Applicant shall arrange for the attendance of the construction manager, <br />contractor, and all subcontractors who are responsible for grading and <br />erosion controls. <br />17.Applicant shall submit a construction equipment and construction <br />employee staging and parking plan as part of the Construction Permit <br />submittal for Phase I of the Project. <br />ArNRES0.2841/APPROVING THE LAUREL WAY PD PERMIT <br />REV. 03-18-13 VR <br />Pape S or 14 <br />
