8.A. - Page 401 <br />Members of the Planning Commission <br />City of Redwood City <br />February 14, 2013 <br />Page 3 <br />Second, the regulations governing development in the City have changed <br />significantly. On October 11, 2010, the City adopted a comprehensive new General Plan <br />("2010 General Plan"), replacing the 1990 General Plan analyzed in the DEIR. The 2010 <br />General Plan contains numerous new policies, goals and implementation measures <br />relevant to the Project, including policies governing storm drainage and runoff, <br />impervious surfaces, geotechnical analysis, hillside development, floor area ratios, and <br />tree protection. The public must be allowed time to review and comment on the EIR's <br />analysis (or lack of analysis) of the Project's consistency with these new policies and <br />requirements. <br />Third, the environment surrounding the Project site has also changed. Since <br />the original EIR was circulated for public review, several additional development projects <br />have been proposed and/or approved along Laurel Way, indicating new, potentially <br />significant cumulative impacts.2 The public must be provided an opportunity to review <br />the impacts of the Project in light of these changes and to comment on the EIR's <br />treatment of cumulative impacts. <br />In addition to complying with CEQA, a 45 -day comment period would also <br />allow the City time to verify that the Project applicant, Laurel Way Joint Ventures <br />("LWJV"), has been authorized to represent all of the property owners within the <br />proposed development. As you are aware, when an earlier version of the Project came <br />before the Planning Commission, it became clear that none of the lot owners had <br />submitted the proper written authorizations for LWJV to act on their behalf and that two <br />of the lot owners were not even part of the application. LWJV subsequently withdrew its <br />application and the City has been understandably reluctant to proceed with any new <br />project without clear proof that LWJV is currently authorized to act on the lot owners' <br />behalf. See, e.g., Dec. 13, 2011 Letter from Rick Jarvis to Christine Griffith at 3. <br />Remarkably, it still is not clear that LWJV has complied with the City's <br />requirement on this front. We have reviewed the Joinder in Development Applications <br />attendant to the original (and subsequently withdrawn) project, which were received by <br />the City on January 21, 2011, as well as the modified Joinder in Development <br />Applications attendant to the new Project, which were received by the City on October <br />14, 2011, and have noted that, in many cases, the owner signatures in the October <br />2 These projects are located at 3718 Laurel Way and 3724 Laurel Way. <br />HUTE, N]IHALY <br />�;;.--WLLIUB[AGLRun <br />
