7.2.B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> November 4, 2013 <br /> SUBJECT <br /> Revised Resolution associated with the Revised Final Environmental Impact Report <br /> ("RFEIR") and approval of master Planned Development Permit for the Laurel Way Joint <br /> Venture Project <br /> RECOMMENDATION <br /> Adopt a Resolution denying the appeal filed by the Laurel Way Joint Venture and <br /> partially denying and partially granting the appeal filed by Save Laurel Way, and thereby <br /> upholding the March 26, 2013 Planning Commission actions certifying the RFEIR and <br /> approving the master Planned Development Permit (Attachment 1) with conditions, with <br /> a modification to Condition No. 19 to reduce home sizes to those allowed under <br /> Alternative B of the RFEIR. <br /> BACKGROUND <br /> On September 23, 2013, the City Council considered the matter involving cross appeals <br /> of the Planning Commission's March 26, 2013 decision to certify a Revised Final <br /> Environmental Impact Report (RFEIR) and approve a master1 Planned Development <br /> Permit for the Laurel Way Planned Development. The project proposes to develop up <br /> to 16 single-family homes on 18 existing hillside lots, owned by 14 different parties. <br /> (Refer to Attachment 2 for the September 23, 2013 Council Staff Report with <br /> attachments.) The Applicant is the Laurel Way Joint Venture (LWJV or applicant), which <br /> represents the 14 property owners. Cross-appeals were filed by the Applicant and by <br /> Save Laurel Way (SLW), a community group primarily representing neighbors of the <br /> project. <br /> After taking testimony and deliberating on this matter the City Council took the following <br /> actions: <br /> • Certified the Revised Final Environmental Impact Report; <br /> • Approved the Project, with a modified Condition 19 of the Planning Commission <br /> Resolution to reflect Alternative B; <br /> • Denied in part the SLW appeal, with modifications to Condition 19 of the <br /> Planning Commission Resolution Alternative B; and <br /> ' It should be noted the term "master" is a term of art, which simply refers to the first phase and <br /> comprehensive overview of the project and is not a codified term. <br />
