7.2.B. - Page 2 <br /> • Denied the LWJV appeal. <br /> The revised Resolution has now been amended to reflect the City Council's actions and <br /> direction. <br /> ANALYSIS <br /> With the submittal of its 2011 application, LWJV proposed home sizes ranging from <br /> 3,300 to 4,500 buildable square feet (including garage), with an average of 3,809 <br /> square feet (see Table 1, "2011 Application" column, for maximum allowable square <br /> footage by lot number and APN). <br /> On March 26, 2013, the Planning Commission certified the RFEIR and approved a <br /> Planned Development Permit for the development of the Laurel Way Joint Venture <br /> Project. Although the applicant had requested larger home sizes be approved, the <br /> Planning Commission approved the project with smaller homes in accordance with <br /> Alternative B of the RFEIR. Alternative B applied a formula based on average slope of <br /> the lot, with at least 2,000 square feet of maximum floor area (including garage) on each <br /> lot. However, the Planning Commission modified Alternative B to guarantee a home <br /> size of at least 2,000 square feet of livable space, resulting in at least 2,400 square feet <br /> of maximum floor area when including the garage. The Planning Commission's <br /> determination is reflected in Condition No. 19 of the Planning Commission Resolution <br /> No. 13-04. See Table 1, "Planning Commission Approval" column, for maximum <br /> allowable square footage (including garage) by lot number and APN). <br /> Both SLW and LWJV appealed the Planning Commission's decision. SLW challenged <br /> the Planning Commission's decision on a number of grounds arguing in part for less <br /> development. LWJV appealed only Condition No. 19 of the Planning Commission's <br /> decision contending larger home sizes were appropriate. <br /> In the exercise of its independent judgment, the City Council determined that it was <br /> appropriate to approve the development in accordance with Alternative B of the RFEIR. <br /> Accordingly, the City Council modified Condition No. 19 to conform home sizes to those <br /> allowed under Alternative B of the RFEIR, without the revision that the Planning <br /> Commission had made. Table 1, "City Council Approval" column, provides the <br /> maximum allowable square footage by lot number and APN, with the °+rilio4hrr�i,nh <br /> figures identifying the differences between the City Council approval and the Planning <br /> Commission approval. Property owners are guaranteed at least 2,000 square feet of <br /> maximum allowable floor area (including the garage) although some homes could be <br /> larger allowing residences in the range of 2,000 to 3,432 square feet with an average of <br /> 2,503 square feet. <br />
