CITY is the IMPLEMENTING AGENCY for: <br /> Project Approval and Environmental Document (PA&ED), which includes preparation of <br /> project approval and environxnental documentation (including the Project Report and <br /> Environmental Document) for CALTRANS' consideration and final approval according to <br /> the Scope below, and does not include construction activities. <br /> 12. CALTRANS is the CEQA lead agency for PROJECT. <br /> 13. CALTRANS is the NEPA lead agency for PROJECT. <br /> 14. CITY will prepare all environmental documentation including, but not limited to, environxnental <br /> technical reports and studies, notices as well as a Uniforxn Filing System as dedicated on the <br /> CALTRANS Standard Environxnental Reference(SER)far the PROJECT. <br /> 15. CALTRANS will provide Independent Quality Assurance (IQA) far the portions of WORK within <br /> existing and proposed SHS right-of-way. Per NEPA Assignment and CEQA statutes, CALTRANS <br /> will perform its QGQAP process review for environxnental documentation. <br /> SCOPE <br /> Scope: General <br /> 16. CITY will perform all OBLIGATIONS in accordance with federal and California laws, regulations, <br /> and standards; FHWA STANDARDS; and CALTRANS STANDARDS. <br /> 17. CALTRANS retains the right to reject noncompliant WORK, protect public safety, preserve <br /> property rights, and ensure that all WORK is in the best interest of the SHS. <br /> 18. CITY will ensure that personnel participating in OBLIGATIONS are appropriately qualified or <br /> licensed to perforxn the tasks assigned to them. <br /> 19. PARTNERS will invite each other to participate in the selection of any consultants who participate <br /> in OBLIGATIONS. <br /> 20. If WORK is done under contract(not completed by CITY's own employees) and is governed by the <br /> California Labor Code's definition of "public warks" (section 1720(a)), CITY will conform to <br /> sections 1720 — 1815 of the California Labar Code and all applicable regulations and coverage <br /> determinations issued by the Director of Industrial Relations. <br /> 2L CALTRANS will issue, upon proper application, the encroachxnent permits required for WORK <br /> within SHS right-of-way.
