RE PORT $�A. - Page 1 <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> November 18, 2013 <br /> SUBJECT <br /> Appeal of the Tentative Map, Condominium Permit, Planned Development Permit, and <br /> Downtown Planned Community (PC) Permit for a new development consisting of up to <br /> 471 residential units and approximately 10,000 square feet of commercial uses at 525 <br /> Middlefield Road approved by the Planning Commission on September 3, 2013 <br /> RECOMMENDATION <br /> 1 . Hold a public hearing on the Appeal. <br /> 2. Adopt a Resolution (See Attachment 1 - City Council Resolution) denying the appeal <br /> and modifying the Planning Commission decision of September 3, 2013, based on the <br /> revised project materials dated November 8, 2013, and upon considering the Initial <br /> Study Checklist and approving the Tentative Map, Condominium Permit, Planned <br /> Development Permit and Downtown Planned Community (PC) Permit for the revised <br /> 525 Middlefield Road Project. <br /> BACKGROUND <br /> The Tentative Map, Condominium Permit, Planned Development Permit and Downtown <br /> Planned Community (PC) Permit application was originally submitted by Downtown <br /> RWC Res, LLC (Applicant) in November 2012 for a complex of 3 — 10 story towers and <br /> 2 — 3 story podium buildings for up to a total of 471 residential units, approximately <br /> 10,000 square feet of commercial space to house the San Mateo Credit Union (SMCU) <br /> offices, and approximately 3,000 square feet for a leasing office. Included in the project <br /> proposal is the applicanYs concept of unbundled parking. <br /> The Planning Commission, on September 3, 2013, approved the Tentative Map, <br /> Condominium Permit, Planned Development Permit and PC Permit for the Project, upon <br /> considering the Initial Study (IS); refer to Planning Commission Resolution PC13-21 , <br /> Attachment 4. <br /> An appeal to the City Council of the Planning Commission's action was filed by 605 <br /> Middlefield Road LLC (Appellant) on September 19�h, 2013 (Attachment 9). <br /> In response to the appeal the Applicant entered into discussions with Appellant, <br /> resulting in a mutually agreeable design solution as documented in a Settlement <br /> Agreement and Release (Attachment 15 - Revised Plans dated November 8, 2013 and <br /> Attachment 16 - AppellanYs Letter of Support for the Project). The corresponding design <br /> and structural modifications to the project include: a) some changes to the fa�ade <br /> composition for the Bradford Street elevation, and b) some changes to the building <br /> placement for the Bradford and Jefferson buildings. <br /> Page 1 <br />
