8.A. - Page 67 <br /> Section 2_ Initiai Study Checklist (1S): The Planning Commission finds that: <br /> a, The IS was prepared in accordance with all legal requirements. <br /> b. The Planning Commission has reviewed and analyzed the IS <br /> and okher information in the entire record and has considered the information contained <br /> therein, including the written and oral comments received at the public hearing on <br /> the Project, prior to acting upon or approving the Project. <br /> c. Based on substantial evidence in the record, the proposed <br /> Project is within the scope of the previously approved Downtown Precise Pian and is <br /> adequately described in the previously certified Downtown Precise Plan Program EIR <br /> for purposes of CEQA. The mitigation measures and Statemeni of Overriding <br /> Considerations associated with certiflcation of the Program EIR address the <br /> environmental effects of the Project. <br /> d. As set forth in CEQA Guidelines sections 15162 and 15168, the <br /> proposed project will not result in any new environmental effects or require new <br /> mitigation measures beyond those identified in the Downtown Precise Plan Program <br /> EIR and adopted upon approvai of the Downtown Precise Plan. No new environmental <br /> document is required. <br /> e. Pursuant to Guidelines section 15091(e), the documents and other <br /> materials that constitute the record of proceedings upon which the Planning <br /> Commission has based its decision are located in and may be obtained from, the Office <br /> of the City Gerk at 1017 Middlefield Road, Redwood City California. The City C(erk is <br /> ihe custodian of records for all matters before the Ci#y. <br /> Section 3. Tentative Map TM2012•08: ThePlanning Commission finds that: <br /> a. The map, design, and improvements of the proposed subdivision <br /> are consistent with the City of Redwood City General Pian, the Downtown Precise <br /> Plan, the City of Redwood City Municipal Code, the City of Redwood City Zoning ' <br /> Ordinance, and ail applicable subdivision improvements requiremenls; ', <br /> b. The site of the proposed subdivision is physically suited for the � <br /> type and density of ihe proposed development; <br /> c. The design and proposed improvements are not likely to cause <br /> substantial environmental damage, or substantially and avoidably injure fish, wildlife <br /> or their habikat, or cause serious public health problems; and ; <br /> d.
