The Appeal is scheduled to be heard by the City Council on <br /> November 18, 2013. <br /> We wanted to inform the City that we have entered into a settlement agreement with the Project <br /> applicant resolving all issues relating to the Appeal and Project. The applicants have submitted <br /> materials to the City to revise the building elevation along Bradford Street This Project <br /> modification addresses all of our concerns regarding the Project and the issues that we have raised <br /> on Appeal. As part of the Settlement Agreement, we have agreed not to pursue any administrative <br /> orjudicial acrions or remedies regarding the Project against the City or applicant. <br /> The Settlement Agreement is contingent on the City Council taking final action on November 18, <br /> 2013 to affirm the Planning Commission Project Approval with the modification to the Bradford <br /> Street elevation. Therefore, we strongly urge the City to support the Proj ect as modified and take <br /> all actions necessary so that the City Council can consider final approval of the Project on <br /> November 18, 2013. <br /> We also respectfully request that the City Council take action to affirm the Planning Commission <br /> ProjecY Approval with the Bradford Street elevation modification on November 18, 2013. Such an <br /> action will resolve the Appeal and dispute so that we will not have to file a lawsuit and pursue legal <br /> remedies against the City and applicant regarding the Project. <br /> We are happy that we were able to resolve our concerns through negoriation with the applicant <br /> rather than litigation against the applicant and City. We appreciate your consideration of our <br /> request to affirm the Planning Commission Project Approval with the Bradford Street elevation <br />
