"Consultant Contract" is defined in Section 2.2.3. <br /> "Consultant Fees" is defined in Section 2.2.3. <br /> "Contributions" means the Education Contribution, Arts and Music Contribution, <br /> Recreation and Wellness Contribution, Economic Development Contribution, Storm Water <br /> Contribution, Water Tank Contribution, Bus Shelter Contribution, Bicycle Contribution, <br /> Community Sustainability Fund Contribution and Neighborhood Streets Enhancement Program <br /> Contribution. <br /> "Control" is defined in Section 6.1. <br /> "CP Index" is defined in Section 3.3. <br /> "Default" is defined in Section 5.2.2. <br /> "Default Hearing" is defined in Section 5.2.3. <br /> "Developer" means Stanford University and its approved successors and Assignees. <br /> "DevelopmentAgreement Statute" is defined in Recital A. <br /> "Development Project" means a development project as defined by section 65928 of the <br /> California Government Code. Notwithstanding section 65928 of the California Government <br /> Code, Development Project shall also include all ministerial approvals required to carry out, <br /> construct, reconstruct, and occupy such a development project. <br /> "Economic Development Contribution" is defined in Section 3.8.1. <br /> "Education Contribution" is defined in Section 3.8.4. <br /> "Effective Date" means the date that this Agreement becomes effective as determined <br /> under Section 1.2. <br /> "EIR" is defined in Recital D. <br /> "ENR Index" is defined in Section 3.2. <br /> "Enacting Ordinance" means the Ordinance approving this Agreement as referenced in <br /> Recital J. <br /> "Exactions" means exactions that may be imposed by the City as a condition of <br /> developing the Project, including in-lieu payments; requirements for acquisition, dedication or <br /> reservation of land; and obligations to construct on-site or off-site public and private <br /> infrastructure improvements such as roadways, utilities or other improvements necessary to <br /> support the Project, whether such exactions constitute subdivision improvements, mitigation <br /> measures in connection with environmental review of the Project, measures imposed for the <br /> protection of the public health or safety, or impositions made under Applicable City Regulations. <br /> For purposes of this Agreement, Exactions do not include Impact Fees. <br /> 5 <br /> ATTY/AGR/2013.134/STANFORD DEVELOPMENT AGREEMENT <br /> REV: 08-14-13 PT <br />
