62. The Declaration of Annexation for Parcels 3C and 3D of the One Marina Residential <br /> Community, or any part, shall be reviewed and approved by the City prior to any Final <br /> Map approval and shall be recorded concurrently with any Final Map. <br /> 63. Applicant shall comply with all other necessary Engineering, Fire, and Building <br /> Department requirements. <br /> 64. Applicant shall comply with all City, State and Federal regulations applicable to the <br /> project. <br /> 65. Pursuant to Section 66474.9(b) of the California Government Code and/or Redwood City <br /> Municipal Code Section 1 .54, Applicant shall defend, indemnify, and hold harmless the <br /> City, its agents, officers, and employees from any claim, action, or proceeding against the <br /> City or Its agents, officers or employees, to attack, set aside, void, or annul an approval of <br /> the City, including but not limited to the City, and the City's agents, officers or employees, <br /> concerning the tentative map and/or development permit. The City shall promptly notify <br /> Applicant of any such claim, action or proceeding and shall cooperate fully in the defense. <br /> 66. No building or zoning permit shall be issued, and no use shall be established except in <br /> accordance with and subject to the terms and conditions outlined above, and in no case <br /> shall such permit be issued or use established prior to the final action on any appeals that <br /> may be filed within the appeal period. Any appeal made in accordance with the provisions <br /> of Article 48 of the Zoning Ordinance must be received by the City Clerk no later than <br /> fifteen calendar days after the date of the notice of the decision. As such, the Planned <br /> Community Permit Amendment, Vesting Tentative Map, Condominium Permit and <br /> Planned Development Permit shall become effective on the sixteenth (16th) day following <br /> the date of the notice of decision unless an appeal to said decision has been filed in <br /> accordance with the provisions stated above. <br /> Section 8.
