7.1.A. - Page 9 =P does not commit The City to enter into a contract, nor does it obligate The City <br /> to pay for any costs incurred in preparation and submission of Proposals or in <br /> anticipation of a contract. The City reserves the right to: <br /> • Make the selection based on its sole discretion; <br /> • Reject any and all Proposals; <br /> • Issue subsequent Request for Proposals; <br /> • Postpone contract start date for its own convenience; <br /> • Remedy technical errors in the RFP process; <br /> • Approve or disapprove the use of particular sub - consultants; <br /> • Negotiate with any, all or none of the Proposers; <br /> • Accept other than the lowest offer; <br /> • Cancel the RFP and reject any and all quotations in whole or in part when it is in <br /> the best interest of The City; <br /> • Waive informalities and irregularities in the Proposals or <br /> • Enter into an agreement with another Proposer in the event the originally <br /> selected Proposer defaults or fails to execute an agreement with The City. <br /> An agreement shall not be binding or valid with The City unless and until it is executed <br /> by authorized representatives of The City and of the Proposer. <br /> 3.6. RFP Timeline <br /> The RFP Timeline is as follows: <br /> Action Date <br /> RFP Issued Wednesday, October 23, 2013 <br /> Deadline for Questions Tuesday, October 29, 2013 by 3:00 p.m. PDT <br /> Answers to Questions Released Friday, November 1, 2013 by 3:00 p.m. PDT <br /> RFP Submittal Deadline (Due Date) Friday, November 8, 2013 by 9:00 a.m. PDT <br /> Selection November 2013 <br /> Contract Award November to December 2013 <br /> 4. Award of Contract <br /> 4.1. When Award Occurs <br /> Award of contract occurs when a Purchase Order is issued or other evidence of <br /> acceptance by The City is provided to the Proposer. A Recommendation of Award does <br /> not constitute award of contract. <br /> 4.2. Award <br /> If a contract is awarded, it shall be awarded to the responsive and responsible Proposer <br /> whose offer conforming to the RFP will be most advantageous to The City. The <br /> submitted quotation schedules (Attachment A) will be completely filled out and include <br /> an "n /a" in sections where no response, pricing, or options are available.
