SOUTH BAYSIDE SYSTEM AUTHORITY <br /> estimates of the cost of construction of Stage 2 of the Project. Thereupon, the Authority shall <br /> advise each Agency of the adjusted fee, and each such Agency shall undertake <br /> implementing and charging such adjusted fee in its wastewater connection fee system in <br /> compliance with California Government Code Sections 66000 et seq. (including 66013 and <br /> 66016), within three (3) months of notice thereof from the Authority and the Agencies shall <br /> complete their proceedings with respect to enactment of said fee or adjustment within a <br /> reasonable period of time not to exceed six (6) months...." [Note: remainder of this third <br /> paragraph not included] <br /> The above language will be drafted and circulated through the SBSA Technical Committee <br /> and through Member Agency's legal counsel prior to presentation to the SBSA Commission, <br /> and ultimately Member Agency governing bodies. <br /> It is also noted that language in the current JPA and in the proposed Amendment VI <br /> regarding excess funds being returned to Member Agencies is old language. The funds and <br /> reconciliation of said funds is old language in the JPA and this reconciliation occurred many <br /> years prior and is not related to the current time. <br /> And finally, please be aware that the SBSA Commission rescinded its earlier <br /> recommendation of increasing the SBSA Connection fee from $7.91 to $10.80 when <br /> Redwood City requested further documentation of the need for the increase. SBSA has <br /> performed a new study, completed by Brown and Caldwell, Inc., to provide updated <br /> information regarding needed work and costs related to expanding capacity of the facilities. <br /> However, as of this date, SBSA staff has not made a recommendation to the Commission to <br /> change the current rate of $7.91 per gallon. The current SBSA connection fee is $7.91 per <br /> gallon per day of flow and shall remain so until the SBSA Commission approves a <br /> recommended change and all Member Agency governing bodies approve the increase as <br /> required by the JPA. <br /> Again, thank you for your strong efforts in resolving these issues and I look forward to <br /> Redwood City's approval of Amendment VI on January 27, 2014.
