Again, I would like to thank you for working with me to arrive at a workable solution to <br /> the issues we have faced. I am sending this letter to confirm the items we discussed and the <br /> actions we agreed to implement. <br /> First, the City agreed to proceed with the recommendation to the City Council to approve the <br /> proposed Amendment VI (dated 2012) to the JPA regarding the allocation of capital costs <br /> and also addressing the implementation of fees for connections to the SBSA system at the <br /> council meeting scheduled on January 27, 2014. Agreement to proceed accordingly is based <br /> on my promise to present to the SBSA Commission a new proposed amendment to the JPA <br /> that will address concerns the city raised in relation to the implementation of the connection <br /> fees. <br /> This letter confirms SBSA legal counsel and I will submit to the SBSA Commission the <br /> language as submitted to you by SBSA legal counsel, Mr. David E. Schricker and accepted <br /> by you in your email of Wednesday, January 22, 2014. The following is the language as <br /> submitted and agreed: <br /> "The Authority shall notify each Agency of the amount of said fee, and each such agency <br /> shall proceed with implementing and charging such fee in its wastewater connection fee <br /> system such that that portion of the wastewater connection fee (howsoever designated by the <br /> Agencies, respectively) charged, assessed or otherwise collected by said Agencies which <br /> provide for the cost of construction of Stage 2 of the Project shall be uniform amongst all of <br /> said Agencies. Not less than annually the Commission shall review said fee and make such <br /> adjustments thereto as are necessary or appropriate to reflect current and projected <br />
