The
Senior Planner explained the necessity to inventory and photograph all illegal or non-
conforming signs. Attorney Boland explained that judges tend to dismiss such cases due
to crowded calendars and more important issues as per their perspective.
Discussion ensued regarding the practical and legal difficulties involved and policy
options regarding grandfathering existing non-conforming signs, amortize all or partial
signs, requirements and enforcement process.
There was agreement that it was in the best interest of the City to adopt some form of
new sign regulations, to give staff a clearer situation to describe to applicants. It was
understood that the draft ordinance would be presented to the Planning Commission for
recommendation and that the Commission would make a recommendation on the issue of
amortization to the Council. Staff also committed to develop as detailed an estimate of
the costs to enforce the ordinance as possible.
3.
