WHEREAS, on September 3, 2013, the Commission held a duly noticed <br /> public hearing and received public testimony on the Draft EIR and the Project; <br /> and <br /> WHEREAS, the City prepared written responses to the comments <br /> received during the Draft EIR public review period and included these responses <br /> in the Final EIR and prepared a separate document entitled, "Mitigation <br /> Monitoring and Reporting Program Cambridge Academy Project, SCH# <br /> 2013012016, November 2013," which together with the Draft EIR constitutes the <br /> Final EIR; and <br /> WHEREAS, on November 8, 2013, the City released the Final EIR for a <br /> 10-day public review period pursuant to CEQA and the CEQA Guidelines; and <br /> WHEREAS, the Commission is the "decisionmaking" body for the Project <br /> under the applicable provisions of CEQA, the CEQA Guidelines (including but not <br /> limited to Section 15090 of the CEQA Guidelines), and the Redwood City <br /> Municipal Code and Zoning Ordinance; and <br /> WHEREAS, on November 19, 2013, the Commission conducted a duly <br /> noticed public hearing, in accordance with all applicable requirements of the <br /> State Planning and Zoning Law and the Redwood City Zoning Ordinance, <br /> received and considered oral and documentary evidence on the application, and <br /> considered and certified the Final EIR for the Project prepared in accordance <br /> with the requirements of CEQA, the CEQA Guidelines, and the Redwood City <br /> Municipal Code and Zoning Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING <br /> COMMISSION OF THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> Section 1. The Planning Commission finds that the above recitals are <br /> accurate and constitute findings in this matter and, together with the Staff Report <br /> and the application materials, including without limitation the Final EIR, <br /> development plan, and all other documents, reports, studies, memoranda, maps, <br /> oral and written testimony, and materials in the City's file for the application and <br /> the Project, and all adopted City planning documents relating to the Project and <br /> the property including the City's General Plan, Municipal Code, Zoning <br /> Ordinance, and other applicable City laws and regulations, and all associated <br /> approved and certified environmental documents, have together served as an <br /> adequate and appropriate evidentiary basis for the findings and actions set forth <br /> in this Resolution. <br /> Section 2. The City of Redwood City is the lead agency under CEQA <br /> for preparing the Final EIR and the Planning Commission of the City of Redwood <br /> City is the decisionmaking body with regard to approval of the Cambridge <br /> ATTY/RES0.2930/PC RESO FINAL ER CAMBRIDGE ACADEMY <br /> REV:01-10-14 JS <br /> Page 2 of 8 <br />
