WHEREAS, on September 3, 2013, the Commission held a duly noticed public hearing and received public testimony on the Draft EIR and the Project; and WHEREAS, the City prepared written responses to the comments received during the Draft EIR public review period and included these responses in the Final EIR and prepared a separate document entitled, "Mitigation Monitoring and Reporting Program Cambridge Academy Project, SCH# 2013012016, November 2013," which together with the Draft EIR constitutes the Final EIR; and WHEREAS, on November 8, 2013, the City released the Final EIR for a 10-day public review period pursuant to CEQA and the CEQA Guidelines; and WHEREAS, the Commission is the "decisionmaking" body for the Project under the applicable provisions of CEQA, the CEQA Guidelines (including but not limited to Section 15090 of the CEQA Guidelines), and the Redwood City Municipal Code and Zoning Ordinance; and WHEREAS, on November 19, 2013, the Commission conducted a duly noticed public hearing, in accordance with all applicable requirements of the State Planning and Zoning Law and the Redwood City Zoning Ordinance, received and considered oral and documentary evidence on the application, and considered and certified the Final EIR for the Project prepared in accordance with the requirements of CEQA, the CEQA Guidelines, and the Redwood City Municipal Code and Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF REDWOOD CITY, AS FOLLOWS: Section 1. The Planning Commission finds that the above recitals are accurate and constitute findings in this matter and, together with the Staff Report and the application materials, including without limitation the Final EIR, development plan, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the application and the Project, and all adopted City planning documents relating to the Project and the property including the City's General Plan, Municipal Code, Zoning Ordinance, and other applicable City laws and regulations, and all associated approved and certified environmental documents, have together served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this Resolution. Section 2. The City of Redwood City is the lead agency under CEQA for preparing the Final EIR and the Planning Commission of the City of Redwood City is the decisionmaking body with regard to approval of the Cambridge ATTY/RES0.2930/PC RESO FINAL ER CAMBRIDGE ACADEMY REV:01-10-14 JS Page 2 of 8
