ATTACHMENT 3 <br /> 78. The placement of above ground utilities must be coordinated through the <br /> CDD Department. Where feasible the utilities shall be screened from the <br /> public vantage point. Where it proves infeasible to screen utilities, the <br /> finish treatment on the utilities shall be coordinated to reduce the overall <br /> visual impact from the public vantage point. <br /> 79. The applicant shall work with CDD, the Police Department and the Fire <br /> Department to ensure that adequate accessibility is provided for <br /> emergency response vehicles throughout the project site as deemed <br /> necessary by City staff. <br /> 80. No permit shall be issued for this project until the Final Map has been <br /> recorded against the project site. <br /> 81. In accordance with the Zoning Ordinance Article 46.11 (Planned <br /> Development Permits, Expiration) a PD permit will expire after one (1) <br /> year if the applicant has not applied for and been issued a building permit <br /> for the particular project and has initiated actual construction as evidenced <br /> by at least one on-site inspection of completed work by a building <br /> inspector. One one-year extension may be granted by the Zoning <br /> Administrator or the Planning Commission. <br /> 82. In accordance with Municipal Code Section 30.45 (Expiration and <br /> Extension of Tentative Map Approvals), an approved or conditionally <br /> approved Tentative map shall expire eighteen (18) months from the date <br /> the maps was approved or conditionally approved by the Planning <br /> Commission. <br /> 83. Applicant shall submit proposed Covenants, Conditions and Restrictions <br /> (CC&R's) for the Pete's Harbor Residential Community, or any part, for <br /> review and approval by the City prior to any Final Map approval. All <br /> property owners must be members of their HOA. The submittal shall <br /> include an estimate of costs and proposed level of maintenance for each <br /> of the activities identified. <br /> 84. The CC&Rs shall provide for funding and provision of maintenance of all <br /> common facilities, such as streets and utilities, not accepted for <br /> maintenance by a public agency. The CC&Rs shall stipulate that the HOA <br /> is responsible for maintaining landscaping consistent with the Landscape <br /> Maintenance Agreement. The CC&Rs shall be recorded as deed <br /> restrictions with the Final Map. <br /> 85.
