ATTACHMENT 3 <br /> 86. To the extent that any portions of Bair Island Road and/or Uccelli <br /> Boulevard are privately owned and maintained streets, those portions that <br /> are currently private streets shall remain private and shall be so noted on <br /> the Final Map. <br /> 87. Prior to the application for any building permit for the site, two copies of <br /> the approved and recorded CC&Rs shall be submitted to the City <br /> Engineer and Planning Director. <br /> 88. The CC&Rs shall describe how the storm water BMPs associated with <br /> privately owned improvements and landscaping shall be funded and <br /> maintained by the HOA. <br /> 89. Pursuant to Section 66474.9(b) of the California Government Code and/or <br /> Redwood City Municipal Code Section 1.54, Applicant shall defend, <br /> indemnify, and hold harmless the City, its agents, officers, and employees <br /> from any claim, action, or proceeding against the City or its agents, <br /> officers or employees, including but not limited to the Planning <br /> Commission, and the City's and Planning Commission's agents, officers or <br /> employees, involving or related to the City's consideration and/or approval <br /> of the development project. The City shall promptly notify Applicant of any <br /> such claim, action or proceeding and shall cooperate fully in the defense. <br /> 90. No building or zoning permit shall be issued, and no use shall be <br /> established except in accordance with and subject to the terms and <br /> conditions outlined above, and in no case shall such permit be issued or <br /> use established prior to the final action on any appeals that may be filed <br /> within the appeal period. Any appeal must be received by the City Clerk <br /> no later than fifteen (15) calendar days after the date of the official action. <br /> As such, the Planned Development Permit, Vesting Tentative Map, and <br /> Condominium Permit shall become effective on the 16th day following the <br /> date of approval by the Planning Commission unless an appeal to said <br /> decision has been filed in accordance with the provisions stated above. <br /> If approved, no building or zoning permit shall be issued, and no use shall be <br /> established except in accordance with and subject to the terms and conditions <br /> outline <br /> ATIY/RES0.2954/pC PETES HARBOR—APPROVING THE PLANNED DEV PERMIT&VESTING TENTATIVE MAP W/CON D ITIONS OF APPROVAL <br /> REV:01/31/2014 VR <br /> Page 15 of 16 <br />
