ATTACHMENT 3 <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING <br /> COMMISSION BY THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> Section 1. The Planning Commission finds that the above recitals are <br /> accurate and constitute findings in this matter and, together with the Staff <br /> Report and the application materials, including without limitation consideration of <br /> Addendum No. 2 and the 2003 EIR, Project plans, and all other documents, <br /> reports, studies, memoranda, maps, oral and written testimony, and materials in <br /> the City's file for the applications and the Project, and all adopted City planning <br /> documents relating to the Project and the property including the City's <br /> General Plan, Municipal Code, Zoning Ordinance, and other applicable City <br /> laws and regulations, and all associated approved and certified environmental <br /> documents, have together served as an adequate and appropriate evidentiary <br /> basis for the findings and actions set forth in this Resolution. <br /> Section 2. Addendum No. 2: The Planning Commission finds that: <br /> a. Addendum No. 2 was prepared in accordance with all legal <br /> requirements, including CEQA Guidelines section 15164. <br /> b. The Planning Commission has reviewed and considered <br /> Addendum No. 2 and other information in the entire record <br /> and has considered the information contained therein, <br /> including the written and oral comments received at the <br /> public hearing on the Project, prior to acting upon or <br /> approving the Project. <br /> c. Based on substantial evidence in the record, the proposed <br /> Project is within the scope of the previously certified Marina <br /> Shores Village Environmental Impact Report (2003 EIR) and <br /> associated Addendum No. 1 (2007) for the purposes of <br /> CEQA. The mitigation measures and Statement of <br /> Overriding Considerations associated with certification of the <br /> 2003 EIR address the environmental effects of the Project. <br /> Accordingly, all applicable mitigation measures and the <br /> Statement of Overriding Considerations for the significant <br /> unavoidable impacts, including without limitation Impact <br /> 7-15 (Cumulative [2020] With Project Impact on the El <br /> Camino Real / Whipple Avenue Intersection), are hereby <br /> reconfirmed and readopted. <br /> d. As set forth in CEQA Guidelines section 15162(a), there are <br /> no new significant impacts nor any increase in the severity of <br /> previously identified impacts and no new mitigation <br /> measures are required beyond those identified in the 2003 <br /> EIR. <br /> e. Pursuant to Guidelines section 15091(e), the documents and <br /> other materials that constitute the record of proceedings <br /> upon which the Planning Commission has based its decision <br /> ATTY/RESO.2954/PC PETES HARBOR-APPROVING THE PLANNED DEV PERMIT&VESTING TENTATIVE MAP W/COMP ITIONS OF APPROVAL <br /> REV:01/31/2014 VR <br /> Page 2 of 16 <br />
