The City Clerk is the custodian of records for all <br /> matters before the City. <br /> Section 3. Planned Development Permit PD2012-01: Subject to the <br /> parking modifications identified in Section 4 below, the Planning Commission <br /> finds that: <br /> a. The Project and improvements proposed by Planned <br /> Development Permit Application No. PD2012-01 are <br /> consistent with, conform to the intent of, and will <br /> appropriately implement Zoning Ordinance Article 46 for <br /> the Pete's Harbor Project; and <br /> b. The establishment, maintenance and operation of the <br /> Project and improvements proposed by Planned <br /> Development Permit Application No. PD2012-01 will not, <br /> under the circumstances of this particular case, be <br /> detrimental to the health, safety, peace, morals or general <br /> welfare of persons residing or working in the neighborhood <br /> of the Project, or be detrimental or injurious to property or <br /> improvements in the neighborhood of the Project, or to the <br /> general welfare of the City, because the Project has been <br /> found to be consistent with the community goals <br /> established in the City's General Plan and Zoning <br /> Ordinance. <br /> Section 4. Parking Modifications: The Planning Commission finds that: <br /> a. The Project requires parking modifications as follows: <br /> (1) Reduce the minimum number of parking spaces required <br /> from 958 vehicle spaces to 883 vehicle spaces. <br /> (2) Allow for the design of parking spaces to include tandem <br /> parking spaces. <br /> b. The Project, including the parking modifications, will provide <br /> an environment of physical and functional desirability, in <br /> harmony with the character of the surrounding neighborhood <br /> because the project has been designed with the specific <br /> objective of making the most out of the waterfront living <br /> experience for both residents, boat slip lessees, and visitors. <br /> From a design perspective the five-story building has been <br /> designed to wrap the parking structure thereby minimizing <br /> the potential for detracting from aesthetic value of the site. <br /> The five-story building has also been designed in such a way <br /> that multiple courtyards are created allowing for a different <br /> character within each space, but all having a water oriented <br /> experience.
