ATTACHMENT 3 <br /> 30. Prior to Final Map approval, the owner/applicant shall enter into a <br /> Stormwater Treatment Measures Maintenance Agreement in a form <br /> acceptable to the City Attorney for all on-site stormwater treatment <br /> measures associated with the project. . <br /> 31. Prior to Final Map approval, the owner/applicant shall enter into an <br /> Improvement Agreement in a form acceptable to the City Attorney to <br /> guarantee the installation of all improvements required of the project and <br /> to provide for payment of all City inspection and plan check charges <br /> associated with the installation of public and private improvements, <br /> including, but not limited to, streets, sanitary sewers, water, storm drains <br /> and street lights. <br /> 32. The applicant/contractor shall apply for a Construction Improvement <br /> Permit from CDD for work in the City public right-of-way, easements or <br /> property in which the City holds an interest. <br /> 33. If all or a portion of the project site is located in a FEMA special flood <br /> hazard area, the applicant shall adhere to the City's Floodplain <br /> Management Ordinance, Chapter 41 of the City's Municipal Code. <br /> It shall remain the property owners' or subsequent property owner(s)', <br /> responsibility to protect the project from threat of sea level rise, storm <br /> surges, or other means of sea water intrusion. The City takes no <br /> responsibility or liability, other than from a regulatory perspective, for the <br /> adaptive management necessary to maintain the development of this <br /> property, now or in the future. <br /> 34. Applicant shall adhere to the Subdivision Map Act and Chapter 30 of the <br /> City's Municipal Code. <br /> 35. Prior to Final Map approval, the Developer shall submit engineered <br /> Improvement Plans (including specifications & engineers cost estimates), <br /> for approval by the City Engineer, showing the infrastructure necessary to <br /> serve the Project. The Improvement Plans shall include, but are not limited <br /> to, all engineering calculations necessary to substantiate the design, <br /> proposed roadways, drainage improvements, utilities, traffic control <br /> devices, retaining walls, sanitary sewers, and storm drains, pump/lift <br /> stations, street lightings, common area landscaping and other project <br /> improvements. <br /> Vesting Tentative Map Conditions <br /> 36.
