One Council Member brought up the Planned Development Permit (PD). She <br /> understood that the Permit is to look at the cumulative impacts, to aggregate but iYs <br /> become more challenging recently. She says that this is an issue for Council and needs <br /> to be looked at. Mr. Lyon added that the PD provides flexibility and mentioned the <br /> Oakwood Subdivision as an example. He said it is intended to address non-standard <br /> issues and to look for context and site issues. <br /> Vice Mayor Gee followed up with a question regarding the PD, asking if without a PD, <br /> could Council impose Condition 19 and the City Attorney confirmed there is no <br /> mechanism. Vice Mayor Gee shared concerns about who will maintain the <br /> infrastructure. He would like to see binding the responsibility to make the improvements <br /> and binding the cost for maintenance down. Dr. Bell said he would like Staff to come <br /> back regarding the permit, and clarify and educate around those issues. Also, he would <br /> like to get some direction on how we might want to change our ordinances. <br /> Another Council Member suggested that the City have better communications with the <br /> public regarding the permit process. One other Council Member asked Mr. Lyon to <br /> repeat his calculation concerning Alternative B. It was explained that Condition 19 set <br /> a formula with a set minimum of 2,000 square feet and rounding up. Vice Mayor Gee <br /> would like to see a citywide slope ordinance, not so much a hillside slope ordinance. <br /> He pointed out that slopes are not exclusive to the hills. Clarifying comments were <br /> made about Condition 19 by staff. <br /> M/S FousUlra to approve Alternative B, which is the recommendation as made by <br /> staff, to the Planning Commission without the edits from that body (includes the <br /> 2,000 sq. feet as the minimum home size limit, which is inclusive of the garage). <br /> One Council Member commented that he wished this was all handled differently, and <br /> wished all the residents got together and made this a "joint project". He would like to <br /> apply the law correctly and he does not want to create unmitigated impacts. <br /> Mr. Lyon clarified that this option includes the 2,000 sq. feet as the minimum home size <br /> limit— including the garage. <br /> Another Council Member said she will support the motion, but wished that they all <br /> merged lots and had handled the slope by themselves. This Council Member said that <br /> it is not acceptable that the current construction is going on and we need to set up a <br /> good track record so that we show we are serious about the mitigations. A different <br /> Council Member said he is not going to support this motion, because he thought there <br /> was going to be a discussion about the hillside ordinance or slope ordinance and that <br /> would have helped before the meeting. He believes this is out of order. Vice Mayor Gee <br /> said he is supporting this motion, but infill housing is hard and this had a long history. <br /> He feels we owe it to everyone to make decisions. He opined that this is not one-size <br /> fits all.
