City Manager Everett suggested that the Mayor and staff assist Mr. Ugarte in writing the report he will give to the TA listing all the Council's concerns, "so that we are going on record, not in opposition, and not in favor, but a litany of the concerns and the areas we feel need to be further clarified." Mayor Howard asked that a copy of that letter be sent to C/CAG. Council discussion of legal procedures to appoint a new Council Member to fill the vacancy on the Council created by the resignation of former Council Member Buchan, and possible action and appointment; (205) Mayor Howard asked City Attorney Schricker to explain the choices the Council had in filling the vacancy created by the resigntion of Council Member Buchan. City Attorney Schricker said, "Madame Mayor, you requested a review of the legal procedures involving the filling of a vacancy when it occurs on the Council. You do have a report from me. The provisions of the Charter which apply are in Section 9, which provide that 'any vacancy occurring on the Council shall be filled by appointment by the remaining Council Members, but in the event that the remaining Council Members fail to fill such vacancy by appointment within 60 days after such vacancy occurs, they must immediately cause an election to be held to fill the vacancy or such vacancy, provided however, that any person appointed to fill such vacancy shall hold office only until the - REGULAR COUNCIL MEETING MINUTE BOOK NO. 56 FEBRUARY 9,1998 MINUTES Page No. 253 PAGE 11
