I I . . - <br /> Mayor Howard asked for a vote on the original motion, appointing Ian Bain to the <br /> - vacancy on the Council. <br /> ITERATION OF THE MOTION <br /> MIS: CLAIRE/RUSKIN TO APPOINT IAN BAIN TO THE VACANCY ON THE <br /> COUNCIL TO SERVE UNTIL THE NEXT REGULAR ELECTION IN NOVEMBER, 1998 <br /> Council Member Claire summarized the Charter's dictates to the Council and the people <br /> of Redwood City: The person appointed to the current vacancy on the Council will serve <br /> only until the next regular election (November, 1998); the person elected at that election <br /> will serve out the remainder of the term (November, 1999.) <br /> CARRIED BY THE FOLLOWING ROLL CALL VOTE: <br /> AYES: COUNCIL MEMBERS CLAIRE, HARTNETT, RUSKIN AND MAYOR <br /> HOWARD <br /> NOES: COUNCIL MEMBERS IRA AND LEIPZIG <br /> MINUTE ORDER NO. 98-049 <br /> ITERATION OF PREVIOUS MOTION: <br /> At 11:00 p.m. MIS: CLAIREIHARTNETT TO EXTEND THE MEETING TO 11:30 P.M. <br /> - Council Member Leipzig raised a point of order stating that the Minutes of the January <br /> 31, 1998 Council Meeting only reflected the results of a poll (four Council Members <br /> voting) to change the Council Meeting extension deadline ITom a unanimous vote to a <br /> simple majority, and therefore the Council Meeting extension still requires a unanimous <br /> vote. He said, "I would suggest that we put it on the agenda as a regular item and vote on <br /> it." <br /> Mayor Howard congratulated Ian Bain, who thanked the Council and said he would <br /> return shortly to address the Council on the next order of business. <br /> Council Member Hartnett said that the issue of Council Meeting times did appear on the <br /> agenda of the January 31, 1998 adjourned regular meeting workshop, and it had been <br /> voted on. He called for a vote on the Motion. <br /> In response to Council Member Leipzig's request for a legal opinion, City Attorney <br /> Schricker said the ruling the Mayor had made earlier was quite correct and the Council <br /> was entitled to continue its discussion and not be interrupted by a motion with respect to <br /> adjournment. With respect to the issue of the Council Meeting extension deadline, City <br /> Attorney Schricker said, "As I understand it, the Meeting on Saturday (January 31,1998) <br /> was an adjourned regular meeting, and included in that agenda were a series of items <br /> - including consideration of the role of the 11 :00 p.m. adjournment....
