. ,��, <br /> ,.. � <br /> local distribution to consumers, shall be permitted in all <br /> districts provided that a use permit be obtained in each case; <br /> and provided, further, that no use permit granted pursuant to <br /> this subsection shall be effective until reviewed and approved <br /> by the Council, subject to such conditions and modifications <br /> deemed appropriate by the Council. <br /> " (e) Notwithstanding the provisions of Article 42, cor- <br /> porations and public service agencies having powers of eminent <br /> domain may apply for use permits in advance of acquisition of <br /> property rights. Even though construction has not begun, such <br /> permits shall not automatically terminate unless, at the end <br /> of ten years, the permittee has acquired less than 50 percent <br /> of the length of the rights-of-way or area of property concerned <br /> in the permit granted. " <br /> SECTION 26. Section 32. 9 of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> "Section 32. 9 Conditional Exceptions to Height Limitations. <br /> P�Iaximum height limitations set forth elsewhere in this ordinance <br /> may be modified by the Zoning Administrator for the following <br /> buildings and structures: <br /> " (a) Monuments, water towers, observation towers, smoke- <br /> stacks, radio towers, broadcasting masts and aerials, <br /> : water tanks, scenery lofts, cooling towers, gas <br /> holders or drive-in theater screens; provided, <br /> however, that a use permit shall be x'��uix.ecl in <br /> each case. <br /> " (b) Iri any R-5, CA, CN, CB, CG, CP, IR, IP Or GI DiStriCt, <br /> buildings may be erected to a height exceeding the <br /> height specified for such district, provided that <br /> the cubicai content of all buildings on the parcel <br /> shall not be increased beyond that which would be <br /> permitted for buildings erected within the specific <br /> district height limits at the maximum permitted lot <br /> coverage, and further provided that a use permit <br /> shall be required in each case. " <br /> SECTION 27;. Section 32: 15of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> -18- <br />
