� ., <br /> "Section 46.11 Expiration. In any case where a planned <br /> development permit has not been used within one year from the <br /> date of granting by beginning of construction of the improve- <br /> ments which are the subject of the permit, or by the establish- <br /> ment of the use which is the subject of the permit, the permit <br /> shall automatically terminate and be of no further effect; <br /> provided, however, the Zoning Administrator or the Commission, <br /> as the case may be, may extend this time once for an additional <br /> year upon written request of the applicant. Every planned <br /> development permit shall terminate five years from the date <br /> of granting unless otherwise provided by the Zoning Administrator <br /> or the Commission, as the case may be. " <br /> SECTION 67 . Section 48.1 of the aforementioned ordinance is <br /> hereby amended to read as follo�as: <br /> "Section 48. 1 Filing. Any person aggrieved by the <br /> action of the Zoning Administrator, the Commission, or other <br /> administrative official involved in the administration or <br /> enforcement of this ordinance may appeal such action to the <br /> City Council. " <br /> SECTION 68 . Section 48 . 3 of the. aforementioned ordinance is <br /> hereby amended to read as follows; <br /> "Section 48 . 3 Fee. The written notice of appeal shall <br /> be accompanied by a nonrefundable fee of �'ifty Dollars ($50. 00) . " <br /> SECTION 69. Section 48 . 5 of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> "Section 48. 5 Action on Appeal. The City Council <br /> hearing any appeal may affirm, reverse or modify the decision <br /> or determination being appealed as it deems just and equitable <br /> and the ruling or determination thereof shall be final. The <br /> Council may, pending final determination of any appeal , <br /> --38� <br />
