Al1 pipes and monuments shown on the parcel map <br /> hereinafter referred to which are destroyed or displaced during <br /> construction operations shall be replaced by Developer at the time <br /> of the final inspection of the improvements hereunder by City. <br /> 7 . It is agreed that title and ownership of all improvements <br /> constructed for the benefit of City hereunder by Developer shall <br /> vest absolutely in City, upon completion and acceptance of such <br /> improvements by City. <br /> 8 . All work to be provided for in this agreement and more <br /> specifically described in the plans and specifications to be <br /> prepared shall be subject to approval and acceptance by the <br /> Director of Public Works before the release of any security <br /> called for herein. Upon completion of the aforementioned work, and <br /> prior to the release of any security called for herein, Developer <br /> shall furnish City with a complete set of plans and drawings showing <br /> the improvements in their actual or "as built" condition and <br /> location. Partial release of any security called for herein may be <br /> granted, at the discretion of City. <br /> 9 . Developer agrees that if, within a period of one (1) <br /> year after final acceptance of the work done under this agreement, <br /> any improvement or part of any improvement furnished and/or <br /> installed or constructed or caused to be constructed by Developer, <br /> or any of the work to be done under this agreement, fails to fulfill <br /> any of the requirements of this agreement, or the plans and <br /> specifications to be prepared will upon receipt of a request in <br /> writing from City directing the work to be done, without delay and <br /> without any cost to City, repair or replace or reconstruct any <br /> defective or otherwise unsatisfactory part or parts of the <br /> improvement or work. Should Developer fail to act prumptly to makz <br /> such repair, replacement or reconstruction or to otherwise act in <br /> 5 <br />
