. . �� �, <br /> �..:,. .,<r� <br /> y <br /> w ' � <br /> accordance with this requirement to repair, replace or reconstruct, <br /> or should the exigencies of the case require repair, replacement or <br /> reconstruction to be made before Developer can be notified, the City <br /> may, at its option, make the necessary repair, replacement or <br /> reconstruction or perform the necessary work and Developer shall pay <br /> to City the actual cost of such repair plus fifteen percent (15$) . <br /> 10 . Developer agrees, as a condition precedent to the <br /> acceptance of any of the improvements which are the subject of <br /> this agreement, to furnish and file with the City Clerk a good <br /> and sufficient bond, deposit or instrument of credit in the <br /> amount of Forty-two Thousand Nine Hundred and No/100 Dollars <br /> ($42 , 900. 00) , expressly conditioned to secure Developer' s compliance <br /> with the provisions of Paragraph 9 hereof, for a period of one (1) <br /> year after final acceptance of the work done under this agreement. <br /> 11 . Developer shall deposit with City the sum of Twenty-three <br /> Thousand Six Hundred-two and No/100 Dollars ($23 , 602. 00) , for all <br /> engineering, inspection, plan check, laboratory and field testing, <br /> construction, and other services furnished by City in connection <br /> with the development. Developer understands that the <br /> aforementioned sum is an estimate and further agrees to pay to City <br /> the actual cost of providing such services. Developer agrees to <br /> complete payment of such additional sum or sums for the services <br /> provided by City, if any, within ten (10) days after the sending of <br /> a statement by City listing the additional sum to be paid and agrees <br /> that the amount payable shall be increased by ten percent (10�) in <br /> the event payment is not made within such ten (10) day period. Any <br /> part of the deposit or such additional sum or sums not utilized by <br /> City shall be returned to Developer. <br /> 12 . It is mutually understood and agreed that neither <br /> Developer nor any of its agents or contractors are or shall be <br /> considered to be agents of the City of Redwood City in connection <br /> 6 <br />
