HEARING TO CONSIDER A PROPOSAL TO INITIATE EMINENT DOMAIN <br /> PROCEEDINGS to purchase a public roadway easement for the Bair Island Road <br /> Extension Project, which will improve the roadway, extend and continue the currently <br /> existing City street known as Bair Island Road to Pete's Harbor, and serve to confirm the <br /> public use that already exists. The property owner, through attorney Norman Matteoni, <br /> will address the Council on this issue. Under Eminent Domain Law this hearing is not for <br /> the purpose of hearing the general public. (205) <br /> REPORT: Engineering and Construction Manager Joel Patterson, April 6, 1998 <br /> Draft Proposal for Public Access to Inner Bair Island, Norman Matteoni, <br /> POST, 11 pages of text plus Exhibits <br /> City Manager Everett introduced Redwood City's eminent domain attorney, Herman <br /> Fitzgerald, who introduced his daughter, Christine, a senior partner in his firm. <br /> Mr. Fitzgerald, using poster exhibits and blueprints described the subject area, road and <br /> proposed easement. He said the proposed easement extends from the end of the pavement <br /> from the existing Bair Island Roadway out to Pete's Harbor. Mr. Fitzgerald said, "The use <br /> has been as a City street for approximately 40 years... and it is designated in the General <br /> Plan dated January 22, 1990, as a local street." He said, "The project for which the <br /> easement is to be acquired would be a reconstruction of that portion of Bair Island <br /> extension road.... It will be approximately 50 feet in width with bike paths on either side." <br /> Mr. Fitzgerald said the purposes of the project were to accomplish, "increased public <br /> safety by bringing the existing pavement up to City street standards. It will enhance the <br /> public access.... The use will remain the same, and it will also provide continual access <br /> for the adjacent properties...
