He said the <br /> proposal had no provisions for mitigating damages he would suffer with the <br /> proposed amortization; <br /> 6. Planned remodeling is being held in abeyance until all the uncertainties <br /> surrounding the future of the book store are resolved; <br /> 7. First Amendment and tenantllandlord rights need to be protected. He said <br /> removing a 23-year business must be based on extremely compelling reasons, such <br /> as public safety, illegal activities, or eminent domain purposes, which are not <br /> present in this case; <br />- <br /> 8. After a public hearing with no written objections, the Redwood City Planning <br /> Commission approved the proposed SOB ordinance and recommended a <br /> "grandfathering clause." <br /> Mr. DeNardi asked the Council Members to consider his statements and base their <br /> decisions on what they knew to be the facts in this matter. <br /> In response to Council Member Hartnett's questions, Mr. DeNardi said the length of <br /> time remaining on the lease was 7 years, 8 months and 3 days. <br /> Mayor Howard called on anyone else who wished to speak to this issue. <br /> Shannon Dunleavy, 3697 Brandy Rock Way, spoke in support of the proposed <br /> amendments, and said, speaking as a mother, she did not want any more of these kinds <br /> of businesses in downtown Redwood City. Mrs. Dunleavy said she was totally in <br /> favor of First Amendment rights, but asked that Council let the SOBs express these <br /> rights in areas away from residential or busy commercial areas. She asked that <br /> Council add more "sensitive uses" including amusement areas.
