If there is going to <br /> be a delay to the developer, I think it is understood, that that would be at the cost of the <br /> City. I couldn't think otherwise, quite frankly.... If the City says, don't put in any <br /> meters, and then later says, put them in, it will be at City cost. I'm sure that's <br /> understood." <br /> Viee Mayor Ruskin acknowledged that the City did not want to delay Raiser (the <br /> developer), and that there were tax rebates also involved, but asked exactly what the <br /> Council could do formally and informally. <br /> City Attorney Sehrieker said his recommendation would be, "Do not obstruct the <br /> Developer's time line, and to avoid doing that, if you have doubts as to whether there <br /> should be meters installed, then instruct the Developer by change order or otherwise, <br /> not to put the meters in, with the full understanding that the City will bear the full cost <br /> of installing the meters at some later time." <br /> In response to Council questions, Direetor Nelson asked the Council, "Can you pass <br /> the Ordinance and we will get back to you with the information about when we <br /> implement it or when we just remove it from the books?" She said the goal was to <br /> allow the Developer to complete the project in a timely manner. Director Nelson said <br /> the old sidewalks had been removed and the final amenities were being installed, so it <br /> was time to replace the sidewalks now, with or without meters. <br /> Mayor Howard asked if anyone else wished to speak. No one else came forward. <br /> 4) Close public hearing; <br /> MIS: HARTNETT/RUSKIN TO CLOSE THE PUBLIC HEARING. <br /> CARRIED BY UNANIMOUS VOICE VOTE AND HEARING CLOSED AT 8:09 P.M. <br /> MINUTE ORDER NO. 97-217 <br /> 5) Council action; <br /> MIS: CLAIRE/BUCHAN INSTRUCT STAFF THAT THE METERS NOT BE <br /> INSTALLED UNTIL THE COUNCIL HAS AN OPPORTUNITY TO EVALUATE <br /> WHETHER OR NOT PARKING METERS SHOULD BE REQUIRED, AND AT THAT <br /> POINT IN TIME, ANY EXTRA COSTS WILL BE BORNE BY THE CITY (SEE <br /> PASSAGE BELOW) <br /> City Attorney Sehrieker said, "May I recommend there is a contingency that the <br /> Developer's time line would not be deterred by this action... (but) there should be an <br /> option that if it is timely, the developer would still pay. If that's the case.
