8.A. - Page 47 <br /> 1 Powers confirmed that a hand launch ramp would be built, but to date there is no such <br /> 2 marina or ramp. A marina should either be independently operated at this location, or <br /> 3 <br /> should be built first. <br /> 4 <br /> Also very salient is that the US Army Corps of Engineers appears to have granted a <br /> 5 <br /> permit for such a marina, according to communication with the USACE, but it appears <br /> 6 <br /> 7 also to have expired. And a member of the Inner Harbor Precise Plan for the Docktown <br /> 8 and Inner Harbor area advised a member of SF Bay MFA that the City advised the IHPP <br /> participants that water quality would not support marina operations at the Peninsula <br /> 10 <br /> location. A public records request to the City has not yielded any results as of this filing. <br /> 11 <br /> The long and short of it is that this developer has not come through with any marina or <br /> 12 <br /> 13 public access (to the water) promises that it has made to obtain what it wants. <br /> 14 8. Finally a picture is attached to this Appeal showing what this land looked like before <br /> 15 it was taken at$0 fee from the People of the State of California. Navigable waterways <br /> 16 <br /> were filled in and dredged out to make an inner harbor, which is why it must be public. <br /> 17 <br /> None of this was permitted (literally, without permit) and it was an unlawful expansion <br /> 18 <br /> 19 of ownership of slivers of land by Pete Uccelli. More palpable, however, is that it would <br /> 20 not even belong to the Uccelli Family Trust if it were not for the people who led the <br /> 21 "Save Pete's Harbor"campaign of the late 70s and early 80s.The 1983 Act that gave <br /> 22 <br /> Pete "title"to the inner harbor land and ostensibly the right to have the applicant control <br /> 23 <br /> marina operations here, is likely void under federal law of Illinois Central. For that <br /> 24 <br /> 25 reason it should still be considered public trust land, or treated as if it hadn't been given <br /> 26 away: an independent marina operation should be allowed to operate in that space. <br /> 27 Moreover, the City of Redwood City, in its General Plan, for exactly that reason, should <br /> 28 <br /> Appeal of Planning Commission Issuance of PD Permit, Vesting Map and Condo <br /> Permit -- 1 Uccelli Boulevard, Redwood City <br />
