Specifically, you requested a <br /> written response reiterating my previous statement made by e-mail on January 21, 2014 that the <br /> U.S. Fish and Wildlife Service (Service) does not oppose the improvements proposed within an <br /> easement area on Service property, and confirming my authority to make such a statement. <br /> The Service acquired fee title interest in a 6.9411-acre property in the City of Redwood City, <br /> San Mateo County, California, on January 17, 2002 donated by the Peninsula Open Space <br /> Trust (POST) as part of a package of multiple parcels on Bair Island. A portion of the <br /> property that is bounded by the unnamed slough to the west and the Pete's Harbor Marina to <br /> the east is encumbered with an easement that was originally granted in 1965 by the Leslie <br /> Salt Company(the property owner prior to POST) to Peter Uccelli, Jr. for the construction, <br /> maintenance, and use of a roadway for ingress to and egress from the adjacent privately- <br /> owned Pete's Harbor Marina property. The easement area was subsequently developed and <br /> used for parking and storage. When POST donated the property to the Service in 2002, it <br /> included the existing paved roadway and parking lot. <br /> This property is managed by the Service as part of the Don Edwards San Francisco Bay National <br /> Wildlife Refuge (Refuge). The Refuge was established in 1972 by Congress to: 1) preserve and <br /> enhance highly significant wildlife habitat, 2) protect migratory waterfowl and other wildlife, <br /> including species known to be threatened with extinction, and 3)provide an opportunity for <br /> wildlife-oriented recreation and nature study (Public Law 92-330). The roadway and parking lot <br /> located on the subject easement facilitates public access near the Refuge's Bair Island Unit for <br /> visitors wanting to engage in wildlife-oriented recreation and nature study (wildlife observation, <br /> wildlife photography, etc.). <br /> The current proposal by RWC Harbor Communities to develop a residential community on the <br /> adjacent privately-owned Pete's Harbor Marina property includes a plan to modify the existing <br /> roadway and parking lot on the subject easement into a public trail for pedestrians and bicyclists. <br /> The proposal does not include the construction of any private residential or other associated <br />
