03/24/2014 <br /> EIR due to the involvement o�' new significant environmental <br /> effects or a substantial increase in the severity of previously <br /> identified significant effects; and <br /> 2. There are no substantial changes with respect <br /> to the circumstances under which the Project is undertaken <br /> which would require major revisions to the 2003 EIR due to <br /> the involvement of new significant environmental effects or a <br /> substantial increase in the severity of previously identified <br /> significant effects; and <br /> 3. The City is not aware of any new information of <br /> substantial importance, which was not known and could not <br /> have been known with the exercise of reasonable diligence <br /> at the time the 2003 EIR was certified, that meets any of the <br /> standards set forth in CEQA Guidelines section <br /> 15162(a)(3)(A-D). <br /> e. Pursuant to CEQA Guidelines section 15091(e), the <br /> documents and other materials that constitute the record of <br /> proceedings upon which the City Council has based its <br /> decision are located in and may be obtained from, the Office <br /> of the City Clerk at 1017 Middlefield Road, Redwood City, <br /> California. The City Clerk is the custodian of records for all <br /> matters before the City. <br /> Section 3. Planned Development Permit PD2012-01: In the exercise of <br /> its independent judgment, the City Council finds that, subject to the parking <br /> modifications identified in Section 4 below: <br /> a. The Project and improvements proposed by Planned <br /> Development Permit Application No. PD2012-01 are <br /> consistent with, conform to the intent of, and will <br /> appropriately implement Zoning Ordinance Article 46 for <br /> the Pete's Harbor Project; and <br /> b. The establishment, maintenance and operation of the <br /> Project and improvements proposed by Planned <br /> Development Permit Application No. PD2012-01 will not, <br /> under the circumstances of this particular case, be <br /> detrimental to the health, safety, peace, morals or general <br /> welfare of persons residing or working in the neighborhood <br /> of the Project, or be detrimental or injurious to property or <br /> improvements in the neighborhood of the Project, or to the <br /> general welfare of the City, because the Project has been <br /> found to be consistent with the community goals <br /> established in the City's General Plan and Zoning <br /> Ordinance. <br /> ATTY/RES0.2967/CC PETE'S HARBOR—DENYING APPEAL AND APPROVING PROJECT Reso#15336 <br /> REV:03-25-14 VR Muff#603 <br /> Page 4 of 19 <br />
