She said if there were no adverse effects then <br /> she should not have had to post no parking signs, nor consider turning 30 feet of her <br /> front yard into concrete (a previously proposed mitigation), which would not be <br /> appreciated by her neighbors. Ms. Dowling said even though the increase of <br /> pedestrian and vehicle traffic is incremental, it does have a cumulative adverse effect <br /> which is inconsistent with the permit. Ms. Dowling said reducing the day care home <br /> from large to small would decrease traffic and allow a reduction of children running <br /> through their property. <br /> Ms. Dowling said she and her husband knew they couldn't have the whole loaf of <br /> bread - the safety and welfare of their home preserved with no day care traffic on their <br /> property. She said this was one case where half a loaf was better than none. She said <br /> all they were asking for was what they were entitled to under the permit. <br /> Mayor Hartnett called upon the respondents. <br /> Ken Sartain, 743 Canyon Road, said that he and his wife had lived at 743 Canyon <br /> Road for fourteen years, and distributed pictures of the driveway as it appeared ten <br /> years ago. Mr. Sartain said that he and his wife, Michele, were appearing before the <br /> Council to ask the Council "to allow Michele's large family day care to continue as it <br /> is." Mr. Sartain said he knew the Council had received volumes of material regarding <br /> this issue and he would confine his comments to those issues "directly applicable to <br /> the conditions set forth in the permit." <br /> Mr. Sartain referred to Mr. Wolfskill's video tape, and said it focused on their <br /> (Sartain's) easement and it was "fraught with misrepresentation, omissions, <br /> duplications and misinformation." He said it was misleading. Mr. Sartain said "there <br /> have been cases when people have parked on the easement. I think the video shows <br /> almost all of the very few incidences in the past year and half. Not all of them were <br /> day care related, and they were there for only a very short time, minutes, two minutes, <br /> one minute, thirty seconds." Mr. Sartain described one incident where a car had <br /> stalled, and after trying to get it started for ten minutes, he pushed it off the easement. <br /> Mr. Sartain said the appellants refer to 24 round trips per day by day care parents, but <br /> it really was more like 24 round trips per week. He said almost half the cars in the <br /> video were unrelated to day care activity, such as personal visits and after day care <br /> hours. He said sometimes people do not see the posted No Parking signs, or they are <br /> new to the home. Mr. Sartain said he and previous neighbors at 751 Canyon Road had <br /> no problems, and it had always been an "easy and friendly matter just to ask people <br /> 'would you move your car?' No problem. Now the WolfskilVDowlings want to <br /> change the rules. In deference to them we have been diligent in telling everyone not to <br /> park there." He referred to the letter he had sent to the day care parents (included in <br /> the Council packet) asking them not to park on the easement. He said he knew "of no <br /> incidence were the neighbors were directly inconvenienced by our use of the <br /> easement."
