It exists there for the purposes of getting to and <br /> from my property. Its use is not restricted to any purpose. It is there for use by <br /> anyone, at any time, and for any purpose which requires them to get to and from our <br /> home. This includes parents transporting their children to our day care. My use of the <br /> easement over the past fourteen years has been for many and varied purposes. Our last <br /> neighbor had several cars. There was traffic going over there all times of the night or <br /> day. They used our driveway, we used their driveway, there was never a problem. No <br /> where, at any time, have I been shown any law or statute that says we are breaking a <br /> law. .. It has been there for a long time before I or the Wolfskill/Dowlings moved into <br /> our homes." <br /> Mr. Sartain said the day care hours of operation are from 7 a.m. to 6 p.m. on <br /> weekdays when most people are at work. He said he believed the easement "was at the <br /> center of this whole issue... The use of the easement may not be palatable to them, but <br /> they did know full well of its existence when they bought their home. By their own <br /> admission the Wolfskill/Dowlings say in their letter to Planning of August 13, 1996, <br /> that 'reducing the size of the family day care will not solve the problem.' And in their <br /> letter of May 15, 1997 to Tom Passanisi they state 'the easement isn't a City matter.'" <br /> Mr. Sartain said, "I think they want to extinguish the easement by any means for their <br /> own reasons." <br /> - Mr. Sartain said the day care home did not adversely effect the neighborhood. He <br /> said he doubted that the few cars the day care added to Canyon Road would have any <br /> impact. He said he knew of no neighbors whose safety had been jeopardized by the <br /> day care operation. Mr. Sartain asked Council to consider the support they have in the <br /> neighborhood and the "positive effects we have on the community and the children <br /> Michele cares for... We have the support of our immediate neighbors, not all of them, <br /> but quite a few." He said there had been no public outcry. <br /> Mr. Sartain asked the Council not to set a precedent that will effect the thirty other <br /> large family day care homes in Redwood City. "Don't displace parents and children in <br /> need of quality day care." <br /> In response to Council questions regarding the number of parents who use the <br /> easement, Mr. Sartain said their day care home currently has eleven children, but not <br /> all parents use the easement; and that was in response to their letter to them describing <br /> the situation and in deference to the Wolfskill/Dowlings. Mr. Sartain said some <br /> parents have sport utility vehicles that can use the driveway at 743 Canyon Road <br /> without causing damage to their vehicles. He said the apron in front of their driveway <br /> is scarred from vehicles scraping the pavement. Mr. Sartain said none of the parents <br /> stop on Canyon Road and let their children out to run up the driveway by themselves. <br /> -.
