APPEAL of Zoning Administrator's decision NOT to Revoke a Non-Discretionary Permit <br /> for a large Family Day Care Home, 743 Canyon Road, Mr. and Mrs. Ken Sartain, - <br /> Appellants David H. Wolfskill and Lynette M. Dowling, 751 Canyon Road. <br /> The public hearing was held May 19,1997 as noticed. All reports and testimony were <br /> received and the public hearing was closed. Council deferred all action to June 2,1997. <br /> REPORT: Senior Planner Passanisi, June 2, 1997 <br /> Mayor Hartnett sununarized the actions taken on this matter at the May 19, 1997 Council <br /> meeting, and described the written materials received prior to that meeting and the oral <br /> testimony and reports received at that meeting as well. <br /> Councilman Claire advised that he and former Mayor Greenalch were members of the <br /> Council's Streets Committee when the City made improvements to Canyon Road. He <br /> described the difficult engineering problems encountered during that project, especially the <br /> portion of road in front of 743 Canyon Road, the Sartain residence. <br /> In response to Councilman Claire's questions regarding some of the engineering <br /> problems the City encountered during the reconstruction on Canyon Road, Senior <br /> L Engineer Lynch used overheads to outline the road's before and after configurations, <br /> including one rejected design. Engineer Lynch described the City's standards for <br /> substandard streets and said the Canyon Road reconstruction project was the rust time the <br /> City had employed those standards. He said the largest problem occurred at 743 Canyon <br /> Road where the width of the Road was only seventeen and a half feet and widening the <br /> road to twenty feet removed part of the driveway of 743 Canyon Road. This <br /> reconstruction resulted in a steeper driveway at 743 Canyon Road. <br /> Councilman Claire said the portion of the driveway which had been removed had <br /> extended into the City's right of way and the existing driveway had been built without a <br /> permit. He described the difficulties the Engineering Department had with this very <br /> narrow portion of the road. <br /> Senior Engineer Lynch said the Engineering Department had considered the existing <br /> easement when finalizing the plans for reconstruction because the Sartains and other <br /> residents along Canyon Road objected to the other alternatives. <br /> Councilman Claire said, "This was a very difficult portion of the road to satisfy all <br /> concerned.
