<br /> . . . -, <br /> <br /> - In response to Councilwoman La Berge's questions regarding the possible solutions <br /> Councilman Claire suggested, Senior Engineer Lynch said based on his knowledge of the <br /> situation as it now existed, he thought the problem could be addressed for around $21,000 <br /> including engineering. He described the survey and design needed and described two <br /> possible remedies: A mini right turn lane onto the Sartain's driveway minimizing the <br /> steepness of the driveway, which would require retaining walls and an easement; or cut the <br /> driveway off altogether and make it a long drop off area which would require stairs to <br /> reach the property above, in which case the easement would still be in effect but limited to <br /> the residents of the property and not day care users. <br /> Mayor Hartnett restated the motion: "The Council would simply be deferring action on <br /> this matter for a month, reserving jurisdiction. That the instruction to staff is to work <br /> together with the proponents and opponents on whether or not a voluntary arrangement <br /> can come about that would include one or the other of the alternatives or something in <br /> between... If the parties were to agree on it, the possibility depending on what the actual <br /> costs might be, the City might if the alternatives seem to be voluntarily agreed to, that the <br /> City might pick up a third of the cost.... If all of those were agreed to, there would be the <br /> possibility then of restriction on the use of the easement so that in effect it would be for <br /> non day care purposes." <br /> Councilman Claire said, "The easement is the problem in my opinion. It is used as a <br /> - circular driveway basically to drop children off. I find that at certain hours of the day <br /> coming up Canyon Road going north in the evening especially when the sun is going <br /> down, it is almost impossible to see that driveway. . " about the time parents are coming to <br /> pick up children... The original intent of the easement granted in the I950s, was to gain <br /> access to a garage that was in the old house. That is a private matter that we cannot get <br /> involved in. The easement use has changed." Councilman Claire said the Sartains paid <br /> more for improvements to the front of their property than others, and they do have a legal <br /> right to that easement. He said if the Wolfskill/Dowlings want to change the configuration <br /> of that easement they should be willing to contribute financially to that change, because <br /> the easement was there when they bought the property, although they probably did not <br /> know how it was going to be used. Councilman Claire said Senior Engineer Lynch did an <br /> excellent job bringing him up to date on the history and alternatives for this property and <br /> he wanted to thank him publicly.
