Chevrolet sedan upon which he had submitted the bid as above. He offered an alternative that he would be allowed to sell the Citg a 1955 Chevrolet at a price of �1,?36.58 with a turn in value on police � car ��}6 of �650,00 which would be a net cast of �1�086.58. Because of conditiona msn- tioned above, Chief Vilood was unable to make recommendation. Councilman Granger, �rith � the thought that 11+�. Davies should have known that there was no 1951} car available when he offered the bid, moved that the low bid of the Davies Auto Compan� be accepted, sec- onded by Councilman Britschgi. City Attorney advieed that the bid having been opened can not be w3thdrawn. It is within the power of the City Counc3l to throw the Davies bid out and award the bid �o the next lowest bidder. The Davies Auto Company can be given a reasonable tim�a to deliver a 1951} auto, failure to do so leaving him open to action for dama�es. City Attorne� suggested that in lieu of the present verbal statement a written statemsnt be secured indicating that the 1954 car was not available. If this written statement is secured the City then can proceed with a damage suit. It being the consensus of opinion that the entire respons3bility rests with the Daviss Company, the motion to accept the lo� bid was put to � vote �vhich was carried unanimously. `""�'" BID OPENING, 75 CU.
