Because of conditiona msn- <br /> tioned above, Chief Vilood was unable to make recommendation. Councilman Granger, �rith <br /> � <br /> the thought that 11+�. Davies should have known that there was no 1951} car available when <br /> he offered the bid, moved that the low bid of the Davies Auto Compan� be accepted, sec- <br /> onded by Councilman Britschgi. City Attorney advieed that the bid having been opened <br /> can not be w3thdrawn. It is within the power of the City Counc3l to throw the Davies <br /> bid out and award the bid �o the next lowest bidder. The Davies Auto Company can be <br /> given a reasonable tim�a to deliver a 1951} auto, failure to do so leaving him open to <br /> action for dama�es. City Attorne� suggested that in lieu of the present verbal statement <br /> a written statemsnt be secured indicating that the 1954 car was not available. If this <br /> written statement is secured the City then can proceed with a damage suit.
