Fire Chief Lodi <br /> was of the opinion that it would be bad policy to reduce the fire zone requirements� not � <br /> only in this instance but in anp other aection of the City, inasmuch as it was the desire ,� <br /> of the City to bring fire rates down. If the City establishea a policy of zoning downwards <br /> our relations with the Fire Rating Bureau would be jeopardized. Motion carried. <br /> LAND DEVELOP�T COMPANY VERIFIED �LAINi FOR ALLEGED AMOUNT DUE ON IMPROVEMENTS ON HALF OF BAY <br /> ROAD ABUTTING CITY PROPERTY, FIRE STATION N0. 3. CITY ENGINEER REPORT. The Land Develop- <br /> ment Company are claiming a balance due on work done in the vieinity of Fire Station #3 <br /> amounting to ��.,846.63. City En�ineer Jain stated that the agreement w ith Land Develop- <br /> ment covered certain work to be done by them. The City Engineer�s office had submitted <br /> a statement to the Land Development �ompan�r some time ago at which time �1,105.03 had been <br /> paid, however, there appears to be a difference of opinion as to certain items which Land <br /> Developmsnt claims are properly chargeable to the City. The largest tiem in the bill <br /> apparently covers drainage. The City Engineer states that the fire station faces on Sec- <br /> ond Avenue which drains the City toward Bayshore. The drainage work done by the Land <br /> Developm�ent Company apparently is of no value to the City. City Attorney stated that this "�""' <br /> claim has been verified and it is within the province of the Land Developrnent Company to � <br /> attempt collection. He stated there were two things to be considered, one was to deny <br /> the claim and attempt to compromise and the other was to li�igate. Councilman Britschgi <br /> moved that claim be denied on the advise of the City Attorney and the City Engineer, secon- <br /> ded by Councilman Granger and carried. <br /> INTRODIICE AMENDMENT TO FIRE ZONE ORDINANCE, NEW BUILDIIdG CODE. The amending of Ordinance 623 <br /> would tie in fire zones xith new Building Code now being adopted. Councilman Granger in- <br /> troduced the arn�endment, seconded by Councilman Stout and carried. <br /> INTRODUCE ORDINANCE TO REZONE PORTION LOT 7, BLOCK 2, JEFFERSON AVENUE ACRES FROM R-1 TO R-3. <br /> Councilm,an Britschgi moved that the matter be held oeer for two weeks, Clerk to mail out <br /> description of property to allow the Council to look over the same. Motion seconded by <br /> Councilman Royer and carried. �. <br /> RESOLUTION 1?77 OF PRELIMINARY DETERMINATION, INDUSTRIAL WAY IMPROVEMENT. This resolution pro- � <br /> vides for the opening and eAtension of Industrial Way from Whipple Avenue to the northerly <br /> City lim'Lts� paving� sidevealks� curb and gutters, installation of water mains� storm drain <br /> system, acquisition of property, etc. City Attorney explained the adoption of this resolu- <br /> � <br /> tion is the first step to be taken under the 1913 Improvement Act procedure, bonds to be <br /> �.:� <br /> of the 1915 type.
